AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE
STANDARD BUILDING: CODE, 1991 EDITION, AND THE
PALM BEACH COUNTY-WIDE AMENDMENTS TO THE
1991 EDITION OF THE STANDARD BUILDING CODE AS
ADOPTED BY THE CITY OF BOYNTON BEACH
ORDINANCE NO. 92-42; PROVIDING FOR CONFLICTS,
SEVERABILITY, CODIFICATION AND AN EFFECTIVE
DATE.
WHEREAS, pursuant to Chapter 166 of the Florida Statutes municipalities are
empowered to enact and enforce construction and related technical codes and
regulations; and
WHEREAS, pursuant to Chapter 90-445 and F.S. 553(4), (A), The Building
Code Advisory Board of Palm Beach County has reviewed local conditions and, based
on this review, has recommended the adoption of these amendments; and
WHEREAS, the adoption of these amendments, with the exception of Section
113.1.11, will be in the public interest of strengthening the Standard Codes, 1991
Edition for the health, safety and general welfare of the citizens of the City of Boynton
Beach, Florida.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: The Amendments to the Standard Building Codes, 1991 Edition,
said Amendments being attached hereto, all of which have been reviewed by the
Building Code Advisory Board of Palm Beach County, are hereby adopted and
incorporated herein as part of the Minimum Construction Standard of the City of
Boynton Beach, Florida, with the exception of Section 1113.1.11.
~ That all ordinances, codes or parts hereof, which pertain to
construction within the City of Boynton Beach, Florida, in conflict herewith be and the
same are hereby repealed, provided that in the event of a conflict with respect to
administration of the Building Codes, existing administrative laws or rules of the City
shall control.
Section 3: Captions; The Captions, Section Heading and Section designation
used in this Code are intended for convenience of users only and shall have no effect
on the interpretation of the provisions of this ordinance.
Section 4: This ordinance may be retitled, renumbered, or relettered to
accomplish such and the word "Ordinance" may be changed to "Section", "Article", or
any other appropriate words.
Section 5: Should any section or provision of this ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this ordinance.
Authority is hereby granted to codify said ordinance.
This ordinance shall become effective September 1, 1994.
