06-070 II I ORDINANCE NO. 06-070 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEA 4 FLORIDA, AMENDING SECTION 2-16 OF THE COD OF 5 ORDINANCES TO ADD A NEW SUB-SECTION ) TO 6 PROVIDE FOR A UNIFORM PROCEDU FOR 7 NOMINATING AND VOTING FOR THE CHAIR D VICE 8 CHAIR OF CITY BOARDS; PROVIDING FOR ONFLICTS, 9 SEVERABILITY, CODIFICATION AND A EFFECTIVE 10 DATE. II 12 WHEREAS, the City Commission has determin that it is advantageous to have a ] 3 niform procedure for nominating and voting for the air and vice chair of City Boards. 14 NOW, THEREFORE, BE IT 0 AINED BY THE CITY COMMISSION 15 F THE CITY OF BOYNTON BEACH, 16 Section 1. The foregoing " ereas" clauses are hereby ratified and confirmed as 17 made a specific part of this Ordinance upon adoption 18 19 Section 2. 2-16 of Chapter 2, "City Boards and 20 amended to add a new Subsection (h) to read as 21 ollows: 22 h T e Chair and Vice Chair of all Ci boards shall be filled us in 23 24 The Mayor, or the Chairman of the Board conducting the 25 appointment when required by law, shall request nominations. 26 2. The Commission, or Board in such cases that the Board 3 the appointment of Chair or Vice Chair, shall vote n the slate 4 of nominees with each Commissioner 5 indicating the name of the person they wis 6 4. If a nominee receives a majority of vo s on the first ballot, that 7 nominee shall be appointed to the osition. 8 5. If no nominee receives am' rity vote on the first ballot, the 12 third ballot nominee with the lowest umber of votes will be dropped from 9 10 II 6. If no nominee re ives a majority vote on the second ballot, a I be conducted. Each Commissioner or Board 13 rank the nominees in order of preference for 14 appoi ment; the nominees with highest preference ranked "1," 15 th nominee with second highest preference ranked "2," and so 16 forth. The City Clerk shall tally the vote, and the nominee with 17 the lowest tally total will be appointed to the position. 18 7. In the event of a tie on the third ballot, a fourth ballot will be 19 conducted between the nominees with the two lowest tally 20 totals. The nominee that receives a majority of votes on the fourth ballot shall be appointed to the position. Section 3.
