A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, AUTHORIZING AND DIRECTING
EXECUTION OF AN AGREEMENT FOR WATER
SERVICE OUTSIDE THE CITY LIMITS AND
COVENANT FOR ANNEXATION BETWEEN THE
CITY OF BOYNTON BEACH AND PALM BEACH
COUNTY HOUSING AUTHORITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the subject property is located outside of the City limits, but within our

water and sewer service area, located east of Lawrence Road, north of Old Boynton Road and
15
south of Lake Worth Drainage District Lateral canal no. 23; and

WHEREAS, the parcel covered by this agreement is planned to contain 34 new
17
single-family homes located in the Quentin Avenue project area; and
18
WHEREAS, the Palm Beach County Housing Authority will be required to extend
19
water and sewer facilities from the adjacent, serviced properties to the north and west to the
20
proposed housing units; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1.
The foregoing "Whereas" clauses are hereby ratified and confirmed as
24 being true and correct and are hereby made a specific part of this Resolution upon adoption
25 hereof.

Section 2.
The City Commission hereby authorizes and directs the City Manager
27 to execute a Water Service Agreement between the City of Boynton Beach, Florida and the
28 Palm Beach County Housing Authority, a copy of said Agreement is attached hereto as
29 Exhibit "A".

Section 3.
This Resolution shall become effective immediately upon passage.

WHEREAS. Customer has requested tba.t the City of Boynton Beach, FloridaprovideW1ltcr
service to the property owned by Customer; and
WHEREAS. the City of Boynton Bea.chha.s the ability to provide water service to Customers
property; and
WHEREAS, the City of Boynton Bca.c::h lIllll a. policy which conditions the grant of water
services outside ofitll jurisdictionallimitll on lllUlexation of the property to be serviced into the City
at the earliest practi.ca.ble time.
NOW THEREFORE. forlllld in conaidenttion of the privilege ofreceiviDiwater service 1iom
tho Municipal Water System and themutual covcoantll expressed heroin, the City of Boynton Boach
and the Customer, his heirs, SlWCOsson and u....;P. ~ as follows:
1. The City agrees to provide Customer with water service from its Municipal Water
Sys1OO1 to service the real property described as fonows and which Customer i..j,.......dl, is owned by
Customer: (Exhibit A)
2. The Customer and the City hereby agree that there are -1i.. Equivalmll Residential
Connections which City shall service.
3. Tho Customer agrees to pay all costs and foes of enPtoerin&. material, labor,
insta.Ilation and inspection of the filcilities as required by tho City of Boynton Beach Code of
Ordinances or Land DevelopmOllt regulations to provide service to the C"'ltomer's pmmisos. Tho
Customer shall be roeponaiblo for insta1Iation in conformanco with all codes, mles and reaulatiODS
applicable to tho installation and maintonanco ofwater service lines upon the ('1'01- ~pn:misos.
All such lines sIia11 be approved by the Director of Utilities and subject to inspection by tho City
EDginoers. The City ahall have the option of either requiring the Customer to perform the wmk
noces~to conform the lines or tho City mayhavo the workperformed on bcbalfofthe CUstomer.
in which case the Customer will pay in advance all estimated costs thereof. In tho evont the City has
such work performed, the Customer will also advanco such additional funds as may be 1IOC00000000to
pay the total actual costs iDcun'od by the City.
4. Any watcr main cmomion made pursuant to this Aareemont shall be usedonlybythe
Customer, unless written coDllent is lIl'antcd by the City of Boynton Beach for other parties to
connect. All OtllV'e<'tions ahall be made in llCCordaDce with the Codes Ulcl tegulations of Boynton
Beach.
5. Title to all mains, CllCtOIISiODS and other filcilities extonded from the City Water
Distribution System to and including the metered service to Customer shall be vested in tho City
exclusively unless othorwiso conveyed or abandoned to the property owner.
6. The CUstomer agrees to pay all cbargos, deposiu and rates for service 8Ild Ilq1~Ollt
in connection with water service outside the City limits applicable under City (brl;"...,,* and rate
schedules which are applicablo which may be changed from time to time,

shall coopemto with the City and not raise opposition or challenge to such .,,,-.ation if and when
annexation is initiated. The property shall be subject to atmoxation at the option oftb.e City at any
time the property is eligible II11der any avBilable means or method for anncx;ation. Customer will
inform any and all assigns or p1l1'Chaaers of any or part of this property of this covonant and ofthc
