3 A RESOLUTION OF THE CITY OF BOYNTON
4 BEACH, FLORIDA, AUTHORIZING CHANGE ORDER
5 #6 WITH SESSOMS CONSTRUCTION FOR THE
6 BOYNTON BEACH LIBRARY PROJECT;
7 DECREASING THE GENERAL CONTRACTOR'S
8 CONTRACT SUM BY $396,137.52 AND INCREASING
9 THE CITY'S CONSTRUCTION COSTS BY $367,780.00
10 TO PAY FOR OWNER DIRECT PURCHASES FOR A
11 TOTAL NET SAVINGS OF $28,357.52; PROVIDING
12 FOR A $50,000.00 CONTINGENCY; AND PROVIDING
13 AN EFFECTIVE DATE.

15 WHEREAS, the City of Boynton Beach, through owner direct purchases, has been
16 able to take advantage of a Tax/Cost Savings Recovery Program; and
17 WHEREAS, due to these savings the General Contractor's contract will be reduced
18 by the sum of$396,137.52; and
19 WHEREAS, the City's construction costs will be increased by $367,780.00, saving
20 the City a net sum of$28,357.52; and
21 WHEREAS, Change Order #5 was to include the approval of an additional
22 $50,000.00 for contingency work; and
23 WHEREAS, the City of Boynton Beach has reviewed Change Order #6 and has
24 determined that the contract changes set forth therein are both necessary and appropriate.
25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
26 THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Section 1.
The foregoing "Whereas" clauses are hereby ratified and confirmed as
28 being true and correct and are hereby made a specific part of this Resolution upon adoption
29 hereof.

Section 2.
The City Commission of the City of Boynton Beach, Florida does

1 i hereby authorize and direct the approval and execution of Change Order 006 decreasing the
2 General Contractor's contract with Sessoms Construction for the Library Expansion Project
3 by $396,137.32 and increasing the City's construction costs in the amount of $367,780.00
4 for a total savings of $28,357.52 due to owner direct purchases, a copy of which is attached
5 hereto as Exhibit "A".

Section 3.
The City Commission approves $50,000.00 for contingency work
7 requested in Change Order #5.

Section 4.
The new contract sum, including all pnor change orders, owner
9 equipment, owner direct purchases and contingency is $7,237,589.48.

Section 5.
This Resolution shall become effective immediately upon passage.
