BOYNTON BEACH, I 6 REVISING CHAPTER 4, "SITE PLAN REVIEW" , 7 SECTION 5 TO INCREASE THE INITIAL APPROVAL ! 8 PERIOD FOR SITE PLANS FROM TWELVE MONTHS 9 TO EIGHTEEN MONTHS; PROVIDING FOR CONFLICT, 10 SEVERABILITY, CODIFICATION, AND AN EFFECTIVE ~ II DATE. 12 i 13 I 14 WHEREAS, the City Commission does hereby deem it to be appropriate and in , I 15 he best interests of the residents of the City of Boynton Beach to approve the amendments to I I. j' 16 he Code as hereinafter set forth. , , I 17 I: 18 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF , 19 HE CITY OF BOYNTON BEACH, FLORIDA: t. 20 , , 21 Section I. The foregoing. "WHEREAS" clauses are true and correct and hereby ; I 22 atified and confirmed by the City Com~ission.. 23 Section 2. Section 5 of Chapter 4, "Site Plans," of the Land Development 24 egulations, Part III of the Code of Ordinances is amended as follows: , , , 25 Sec. 5. Expiration of site plan. 26 Upon approval of a site plan by the City Commission, the applicant shall 27 I have H-}-yeur ci~htccn months to secure a building permit from the development 28 department. If an applicant fails to secure a building permit in that time, all , , 29 previous approvals shall become null and void. A clearing and grubbing permit 30 shall not constitute a building permit for site plan review purposes. The City I 31 Commission, at its discretion, may extend the approval of a site plan for an , 32 additional time period, not to exceed one-year, provided a request for extension I 33 I is filed prior to the expiration of the originallJ-fle--;'eaf ciQhtecn month period. Conflicting Ordinances. 2 3 II prior ordinances or resolutions or parts thereof in conflict herewith are hereby repealed to the j 4 xtent of such conflict. 5 Section 4. Severability. 6 If any section, sentence, clause, or phrase of this Ordinance is held to be invalid or 7 constitutional by any court of competent jurisdiction, then said holding shall in no way affect I 8 e validity of the remaining portions of this Ordinance. I 9 Section 5. Inclusion in Code.
