6 BEACH, FLORIDA, APPROVING THE FIREWORKS
7 PERFORMANCE CONTRACT BETWEEN THE CITY
8 OF BOYNTON BEACH AND FIREWORKS BY
9 GRUCCI, INC., TO DISPLAY OUR ANNUAL JULY
10 4TH FIREWORKS DISPLAY IN THE AMOUNT OF
11 $40,000.00 AND AUTHORIZING THE CITY
12 MANAGER TO EXECUTE THE CONTRACT; AND
13 PROVIDING AN EFFECTIVE DATE.

15 WHEREAS, on March 7, 2007, the bid opening was scheduled for the Annual
16 July 4th Fireworks Display; and
17 WHEREAS, no proposals were submitted and three "No Bids" were received; and
18 WHEREAS, the City's Special Events Manager contacted Grucci Fireworks who
19 agreed to perform the fireworks display for the City for the budgeted amount, meeting all
20 specifications; and
21 WHEREAS, City staff recommends to the City Commission that it approve the
22 Fireworks Performance Contract between the City of Boynton Beach and Fireworks by
23 Grucci, Inc., for the Annual July 4th Fireworks Display and authorize the City Manager to
24 execute said Contract.
25 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
26 OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Section l.
The foregoing "Whereas" clauses are hereby ratified and confirmed
28 as being true and correct and are hereby made a specific part of this Resolution upon
29 adoption hereof.
Section 2.
The City Commission of the City of Boynton Beach, Florida,

hereby approves the Fireworks Performance Contract between the City of Boynton Beach
2 and Fireworks By Grucci, Inc., for the Annual July 4th Fireworks display in the amount of
3 $40,000.00 and authorizes the City Manager to execute the Contract, a copy of which is
4 attached hereto as Exhibit "A".

Section 3.
That this Resolution shall become effective immediately.

I. AGREEMENT:
Whereas both Fireworks by Grucci, herein referred to as Grucci and the City of Boynton Beach, herein referred to
as Sponsor agree that Grucci shall pending receipt of all required permits, signed contract and payment in full,
produce and display fireworks on the Barge on Intercostals Waterway as follows:

II. SERVICE AGREEMENT:
The Total Fireworks Performance contract cost above is quoted fob Long Island, New York for transportation of
personnel, equipment and fireworks, Services that ueed to be pravided and paid for by the sponsor in addition to
the transportation and site expenses are as follows:
. Security upon arrival until departure at loading and firing locations,
. Provide direct cell phone or 2-way radio communications and to place the barge in the desired firing location to
authorize performance time, Provide equipment, as needed to simulcast or broadcast the music to the audience.
III, PAYMENT SCHEDULE:
Payment of the Total Fireworks Performance Contract for $40,000,00 shall be paid by sponsor as follows:
a) A deposit of $20,000.00 is due and payable with the return of the signed Fireworks Performance Contract on or
before April 18, 2007.
b) The balance of $20,000,00 is due and payable on or before July 5,2007,
c) A fee of $200.00, plus 1 \12% interest will be charged to any unpaid balance per month,
IV. CREDITING:
The sponsor agrees to credit Grucci in all event programs, invitations, press release, advertising, or promotion copy
that is within sponsor's authority.
V, RESCHEDULE DATE:
In the event the fireworks performance is rescheduled for any reason, Grucci will reserve July 5, 2007 accordingly
in consideration for a 10% fee per day of the Fireworks Performance Contract. These costs shall be paid by the
sponsor upon demand. In any event, the sponsor shall be responsible for full contract price and those related costs
as stated above.
VI. GOVERNMENT PERMITS AND REGULA nONS
Grucci shall be solely responsible for obtaining all necessary permits, licenses, and approvals for the performance
of this Agreement. Sponsor agrees to waive and/or shall be responsible for the payment of any and all government
required fees and/or taxes, associated with the fireworks performance and activities undertakeu pursuant to this
agreement.

WHEREAS, during the Ce ery Board meeting on November 8, 2007, the
