MINUTES OF THE CITY OF BOYNTON BEACH AGENDA PREVIEW MEETING
HELD IN BOYNTON BEACH, CITY COMMISSION CHAMBERS
ON FRIDAY, APRIL 13, 2007 AT 9:00 A.M.

CALL TO ORDER:
Mayor Taylor called the meeting to order at 9:01 a.m.
I.D.l. Additions, Deletions, Corrections
Mayor Taylor noted there would be an addition under 1II.c.1.c., a Proclamation for Bishop
Sylvester Banks, Sr. Day for 50 years of service to the community. Under VI. Consent Agenda,
Items F. G. and H. will be added which are disbursements of Community Investment Funds.
Mr. Bressner requested an update on the property tax legislation be added. Mayor Taylor
indicated it could be added under IX. City Manager's Report, Item B. Additional backup will be
provided.
Vice Mayor Rodriguez suggested an update be given on the American Assembly also. Mr.
Bressner agreed an update should be given. Mayor Taylor indicated it would be Item C.
III.A.l.Holiday Parade route for December 1, 2007 Holiday Parade traveling north in
the southbound lane of Federal Hwy. from SE 12th Avenue to East Ocean Ave.
turning west on East Ocean Ave. and South on SE 4th Street.
Kathy Biscuiti, Special Events Manager, noted the parade route had been reversed to bring the
people and parade to the area of the tree lighting and concert.
Commissioner McKoy inquired if other events in the area would conflict with the date. Ms.
Biscuiti had determined other cities were planning parades and events for December 8th.
III.B.1.0ceanfront Concert on April 20, 2007 at Oceanfront Park featuring The Totall
Kontroll Band from 6 p.m. to 9 p.m. Admission is FREE. Food and beverage
vendors available.
Ms. Biscuiti added a new park and ride location had been added at the Bank of America building
with a shuttle to and from Oceanfront Park the entire evening. The concerts have been very
well attended. Mayor Taylor indicated the concerts were very good.

III.B.3. Youth in Government Day on May 3, 2007 giving local high school students
the opportunity to observe and participate in local government.
Commissioner McCray asked for additional information on the reception to be held. Mr.
Bressner would provide further information.
V. ADMINISTRATIVE:
Commissioner McCray directed the resignation of Robert E. Kane be added to the agenda.
Mayor Taylor agreed and requested the residency requirement for Frank Scicchitano be
established.
VI.B.2. Approve the expenditure to Grucci Fireworks of Brookhaven, New York to
display our "ANNUAL JULY 4th FIREWORKS DISPLAY" in the amount of
$40,000 to include the barge.
Commissioner McCray inquired if there would be any problems associated with the barge.
Bobby Jenkins, Assistant Director of Financial Services, confirmed the contract has been finalized
and no problems were anticipated.
VI.C.2. Proposed Resolution No. R07- RE: Approving and
authorizing execution of a property agreement between the City of Boynton
Beach, Boynton Beach Property Partners and St. Mark Catholic Church to
provide a mechanism to state the developer's intentions and the City's
agreement to abandon.
Mayor Taylor asked if the agreement would abandon the alley. The partners have not agreed at
this point. Jeff Livergood, Director of Public Works and Engineering, advised the agreement
would not abandon the alley, rather signifies the intent of the City to abandon the alley if the
developer and St. Mark agree.
Mayor Taylor's other concern related to the traffic flow with the two developments on both sides
of the Church and School. The traffic flows in 4th Avenue and out on 6th Avenue with right turn
only lanes. There should be a left turn out of 6th Avenue on to Federal Highway and possibly a
traffic light.
Mr. Livergood remarked, at the time of site plan approval, the traffic flow would be addressed.
Warrants were not met for a traffic signal at 4th Avenue with the addition of the Promenade.
The 6th Avenue intersection would be addressed with the new development on that side of the
Church.
Lisa Bright, CRA Executive Director, mentioned meetings had been held with St. Mark to
encourage the creation of a campus entrance. The developer was made aware that the CRA
would require some type of roadway change.
Mayor Taylor inquired about the setbacks for the area once the alley way was abandoned. Ms.
Bright suggested more serious discussion would be needed.

VI.C.3. Proposed Resolution No. R07- RE: Approving and adopting
the Recreation and Parks Department Strategic Plan.
Commissioner McCray inquired if a presentation would be made. Mr. Bressner suggested the
item could be pulled for a presentation. It was determined a presentation was not necessary.
VI. E. Approve the purchase of combined insurance policies for petroleum storage
tanks and environmental impairment liability for three-year period at
guaranteed premium of $39,612.20 total for three years.
Commissioner McCray asked for the location of the petroleum storage tanks. Mr. Bressner
indicated one lift station is on Quantum Park and the other lift station is on Lawrence Road near
Boynton Beach Boulevard. The lift stations are currently fenced.
VII. A.Accept the Settlement Agreement between the City of Boynton Beach and
iStar Bowling Center for the recovery of staff's administrative costs and
attorney's fees of $3,200 associated with Code Compliance Cases 98-2593 &
05-2118. (Proposed Resolution No. R07-047)
Commissioner McCray advised it could be discussed at the meeting as he had questions, but he
was glad that a reduction was done.
Commissioner Rodriguez asked if the figure reflected the true cost of administrative fees and
expenses. Scott Blasie, Code Compliance Administrator, replied the administrative fees were
included. The $3,200 represented the administrative costs of both Code Compliance and the
Legal Department. The case involved an occupational license renewal due to pending Code
violations. Mr. Blasie confirmed the costs were not negotiated.

Request for a one (1) year site plan time extension approval
(NWSP 06-001) granted on March 21, 2006, from March 21,
2007 to March 21, 2008.
Mr. Bressner questioned if interim landscaping would be included in the Conditions of Approval.
Mike Rumpf, Planning and Zoning Director, replied the site was small and the applicant has
responded with revised plans. The site has low exposure and unless there is some type of
problem with the site, beautification would not be required. Commissioner Weiland added it
was a natural wooded area.
Commissioner McCray inquired if this site plan extension would be for eighteen months. Mr.
Rumpf noted the Ordinance was not retroactive and had received approval prior to the Code
change. The extension would remain 12 months.

IX.A. Status report on MLK discussions with Intown
Mr. Bressner had information that a letter from the CRA was forthcoming and should be shared
with the Commission. Lisa Bright, Executive Director of the CRA, advised a letter would be
delivered requesting the Commission consider a June 12th deadline.
IX.B. Status Report on the Property Tax Legislation
Mr. Bressner distributed a side-by-side comparison of all the proposals. Further financial
information would be provided as soon as it became available.
IX.C. Update on the Boynton Assembly process
Mr. Bressner indicated the steering committee had met, and members of the five working
committees were selected. Additional volunteers to fill the openings are needed.
Commissioner McCray requested the razing of Cherry Hill should be added also. Mr. Bressner
agreed and would try to get further information from the Housing Authority. The current
residents do have Section 8 certificates. Backup assistance could be provided by the City such
as looking for apartment complexes.
XII.B.l.Proposed Ordinance No. 07-008 RE: Approving lobbyist
regulations providing for title, purpose, definitions, registration, record of
lobbying contacts, cone of silence, enforcement and penalties and repeal of
laws in conflict.
Attorney Cherof announced there were items notated that required Commission policy direction
before adoption of the ordinance with suggested amendments for second reading.
XII.B.2.Proposed Ordinance No. 07-009 RE: Amending Chapter
15 of the Code of Ordinances, "Offenses-Miscellaneous" to add a new Article
XII, Titled "Loitering".
Mayor Taylor announced a meeting was being held with the Mayors of Boca, Delray, Lantana
and Lake Worth, plus Representative Maria Sachs, to show them the Ordinance and Resolution
being adopted by the City of Boynton Beach. The hope was the other cities would adopt similar
approaches to create a regional plan against violence and gangs. Mayor Taylor will give a
follow up report.
XII.C.l. Proposed Ordinance No. 07-010 RE: Amending Section
18-181 of the Boynton Beach Code of Ordinances to expand the Firefighter
Pension Board's investment authority by permitting investment in all
authorized investments as permitted by Florida law.
Commissioner McCray questioned if the same action was taken for the Police Pension Fund. Mr.
Bressner confirmed the Police and General Employees' Funds had taken the same action.
Attorney Cherof noted it was not a benefit change, just an investment policy.

XII.E.l.Proposed Resolution No. R07-048 RE: Approving and
authorizing execution of an agreement for Mitigation of Roadway
Improvements between the City of Boynton Beach, FL and Boynton Industrial,
LLC.
Attorney Cherof explained the agreement related to the Ocean 95 Exchange and would require
the City to obtain the right-of-way under the 1-95 overpass, handle the costs and taking of the
property, if necessary, and a provision for the developer's share of the cost.
XIV. ADJOURNMENT
There being no further matters to come before the Commission, Mayor Taylor properly
adjourned the meeting at 9:25 a.m.
