AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING APPENDIX A, ZONING, SUBSECTION
ll.H.16. AND SUBSECTION 11. H.
i6.e(12)(e); BY PROVIDING REQUIREMENTS
TO APPLY TO CHANGES IN BUILDING
OCCUPANCY WHICH REQUIRE PROVISIONS FOR
ADDITIONAL PARKING SPACES; BY PROVIDING
LOWERED PARKING SPACE REQUIREMENTS IN
CERTAIN RECREATIONAL FACILITIES;
PROVIDING A CONFLICTS CLAUSE; PROVIDING
A SEVERABIL~TY CLAUSE; PROVIDING
AUTHORITY TO CODIFY; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
NOW THEREFORE, BE IT ORDAINED BY THE CITY CO~H~ISSION OF
THE CITY OF BOYR~fON BEACH, FLORIDA:
Section 1: That Appendix A, zoning, Subsection
ll.H.16, of the Code of Ordinances is amended by adding the
words shown in underlined type and by deleting the words in
struck-through type as follows:
Sec. ll.H.16. There shall be provided, at the time of
the erection of any structure or establishment of any
use, a number of off-street parking spaces in
accordance with the following minimum requirements, and
subject to paragraphs 1 through 15 of this subsection.
Where a structure or use is enlarged or increased in
capacity by any meansx including a change in building
occupancy Wh~Oh re~a~res the provision of additional
parking spaces, or a change tn use to one whic¥
rec~ires additioDal parking spaces, &~e~u~ng -a~d~
~we~ng_~s?_~es~-~eems?-~ee~-a~ea?-e~-sea~s? the
minimum number of parking spaces shall be computed by
applying these requirements to the entire structure or
use.
Section 2: That Appendix A, Zoning, Subsection
ll.H.16.e(12)(e) of the Code of Ordinances is amended by
adding the words shown in underlined type and by deleting
the words in struck-through type as follows:
Sec. ll.H.16.e(12)(e) All other recreation facilities
including athletic courts and swimming pools shall
provide one quarter (1/4) ~e-ha~-%~ of the parking
spaces that would be required by this ordinance, in
addition to required parking spaces for recreational
buildings.
Section 3: All Ordinances or parts of Ordinances in
conflict herewith be and the same are hereby ~epealed.
Section 4: Should any section or provision of this
Ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be
invalid, such decision shall not affect the remainder of
this Ordinance.
Section 5:
Authority is hereby granted to codify
said Ordinance.
Section 6:
This Ordinance shall become effective
immediately upon passage.
