Minutes 04-27-07 MINUTES OF THE CITY OF BOYNTON BEACH AGENDA PREVIEW MEETING HELD IN BOYNTON BEACH, CITY COMMISSION CHAMBERS ON FRIDAY, APRIL 27,2007 AT 9:00 A.M. Present: Jose Rodriguez, Vice Mayor Ron Weiland, Commissioner Mack McCray, Commissioner Carl McKoy, Commissioner Kurt Bressner, City Manager James Cherof, City Attorney Janet Prainito, City Clerk Absent: Jerry Taylor, Mayor CALL TO ORDER: Vice Mayor Rodriguez called the meeting to order at 9:01 a.m. and advised Mayor Taylor was attending another function and was unable to attend the agenda preview meting. I.B. Invocation The City Clerk's office was waiting for a call back for the Invocation. Vice Mayor Rodriguez inquired if any of the Commission would like to volunteer. It was agreed to make that determination at the meeting, if necessary. III. ANNOUNCEMENTS, COMMMUNITY & SPECIAL EVENTS & PRESENTATIONS Vice Mayor Rodriguez advised there would be an announcement to be added. Carisse Lejeune, Assistant to the City Manager, read the announcement of the 1st Annual Blanche Hearst-Girtman Scholarship Fund luncheon that would be added to the agenda. She advised it was not a City sponsored event. V.A. Appointments Vice Mayor Rodriguez noted a revised list had been distributed reflecting new applicants. VI.E. Approve the reduction of a cash surety for Boynton Town Center Project from $108,109.54 by 900/0 to $10,810.95. Commissioner McCray inquired of staff if a reduction had been done in the past. Quintus Greene, Development Director, replied it had been done previously. Commissioner Weiland requested to add a donation of $2,000 from his discretionary funds for the PALS organization. Officer Tome had submitted the paperwork. Commissioner McCray inquired about the date of the Kansas City trip. 1 Minutes Agenda Preview Conference Boynton Beach, FL April 27, 2007 Officer Tome announced the PAL team would be traveling to Kansas City for the National Basketball Tournament June 25 - 30. Thirty-six children, six coaches and two police officers would be attending. The trip would cost approximately $26,000. Funds totally $15,000 had already been collected. It is an open tournament. The 14 Under Division had won the State title this year and the 10 year olds came in second. Commissioner Weiland suggested the kids do some of the fundraising also so they appreciate the donations more. Officer Tome noted several events were planned, including a Family Day at Hester Park with a cook out and basket ball tournament. XI. NEW BUSINESS: Commissioner McCray inquired where the Ocean 95 Exchange would be placed on the agenda. Vice Mayor Rodriguez thought it would be heard under Public Audience since there was no agenda item to discuss. Jeff Livergood, Public Works Director, suggested the funding was included in the CIP budget update under IX. City Manager's Report and could be discussed at that time. XII.D.l.Proposed Resolution No. R07-046 RE: Approving the revision of the procedures governing expenditures of Community Investment Funds; rescinding conflicting provision of previous resolutions and policies governing the procedure for expenditures of Community Investment Funds. (Tabled on April 17, 2007) Commissioner McKoy asked why Item XII.D.1 appeared on the agenda. Attorney Cherof explained the Commission had discussed the change and he had made a recommendation to clarify the investment policy. It was formalized in a Resolution and was now before the Commission for adoption. It was based on the Commission's authority to determine public purpose rather than the City's administration authority. It would streamline the process to get the items on the agenda and approved. The City Manager had also made several suggestions for clarification. Commissioner McKoy was concerned the accountability and transparency would be compromised with the changes. Commissioner Weiland agreed the checks and balances should be in place. Vice Mayor Rodriguez indicated it was on the agenda and could be discussed and perhaps finalized. Commissioner McCray commented for the record that, \\ no elected official has the right to ask another elected official to come down whether they want to come down or not. I was elected by the citizens of Boynton and I can sit up here if I wish and if I wish to adjourn myself, that's my call. That is the ethics of the State of Florida. We need to govern ourselves by what the State of Florida says we are suppose to govern ourselves." 2 Minutes Agenda Preview Conference Boynton Beach, FL April 27, 2007 Vice Mayor Rodriguez indicated his comment was if Commissioner McCray did not like how he was running the meeting, he could leave.
