AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AMENDING ORDINANCE NO.
87-10 BY EXTENDING A TEMPORARY
MORATORIUM ON THE ISSUANCE OF BUILDING
PERMITS FOR THE CONSTRUCTION OR
ALTERATION OF BUILDINGS AND STRUCTURES
BETWEEN THE WESTERN BOUNDARY OF THE
CENTRAL BUSINESS DISTRICT OF THIS CITY
AND THE WESTERN CITY LIMIT ALONG BOYNTON
BEACH BOULEVARD; BY AMENDING SECTION 4
OF SAID ORDINANCE TO INCLUDE
APPLICATIONS FOR SITE PLAN APPROVAL
WITHIN THE MORATORIUM ~D PROHIBIT
SUBSTANTIAL ALTERATIONS OF BUiILDINGS AND
STRUCTURES; BY AMENDING SECTION 7 OF
SAID ORDINANCE TO CONTINUE THIS
MORATORIUM; PROVIDING FOR AUTOMATIC
REPEAL; PROVIDING AN EFFECTIVE DATE; AND
FOR OTHER PURPOSES.
WHEREAS, Ordinance No. 87-10 declared a temporary
moratorium on the issuance of building permits for the
construction or alteration of buildings and structures along
portions of the Boynton Beach Boulevard corridor within this
City; and
W~RREAS, Ordinance 87-10 indicated in Section 7 that
there would be an automatic repeal of the provisions of the
Ordinance as of 11:50 P.M. on the 22nd day of July, 1987;
and
WHEREAS, a new development plan for Boynton Beach
Boulevard has not yet been adopted
Commission of the City of Boynton Beach.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Ail provisions of Ordinance No. 87-10
with the exception of Sections 4 and 7 shall be reaffirmed
and readopted.
Section 2: Section 4 of Ordinance No. 87-10 is
hereby amended by adding the words and figures in underlined
type as follows:
Section 4: Moratorium Declared.
As to any real property located in whole
or in part within any zoning category
which fronts on Boynton Beach Boulevard,
westerly from the boundary of the
Central Business District, and easterly
to the western City limit, there is
hereby declared to be a moratorium on:
1. The acceptance of applications
for, the processing of, and the issuance
of building permits for the construction
or s~stantial alterations of buildings
and structures.
2. The aCceptance of applications
for and the approval of subdivision
plats, including the replatting of
formerly platted properties.
3. The acceptance of applications
for and the issuance of site plan
approval, master plan or plat approval
for planned unit developments.
4. The acceptance of applications
for and the approval of petitions for
the zoning and rezoning of property.
Section 3: Section 7 of Ordinance No. 87-10 is
hereby amended by adding the words and. figures in underlined
type and by deleting the words and figures shown in
struck-through type as follows:
Section 7: Automatic Repeal;
Suspension of Conflicting ordinances and
Resolution. This Ordinance shall stand
repealed as of 11:50 P.M. on the RRnd

1988, provided that nothing herein shall
prevent the readoption or ratification
of this Ordinance in the same or similar
form. During the effective period of
this Ordinance, all other Ordinances and
ReSolutions of the City of B~nto~ea.ch
or portions thereof in conftict~w~i~h
this Ordinance are declared to be
suspended to the extent of such
conflict.
Section 4:
Effective Date. This Ordinance shall
take effect immediately upon adoption.
