REPEALING ORDINANCE NO. 82 -13 AND
ORDINANCE 8 -38; DECLARING THE CITY i
COMMISSION AS THE BOARD OF COMMISSIONERS
OF THE '-COMMUNITY REDEVELOPMENT AGENCY; j
PROVIDING FOR THE DESIGNATION OF THE
CHAIRMAN AND VICE- CHAIRMAN OF THE BOARD
OF COMMISSIONERS OF THE COMMUNITY
REDEVELOPMENT AGENCY; PROVIDING A
!' CONFLICTS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AUTHORITY i
TO CODIFY; PROVIDING AN EFFECTIVE DATE;:
�! AND FOR OTHER PURPOSES
GI WHEREAS, by Resolution No. 82 -KK, the City Commission
of the City of Boynton Beach, Florida, created a Community
I
Redevelopment Agency for said City; and
WHEREAS, pursuant to Section 163.357, Florida Statutes,

the Legislature provides that the governing body of a
municipality may designate itself as the Commissioners of a
Community Redevelopment Agency; and
WHEREA the City Commission of the City of Boynton
Beach, Florida, desires to exercise this alternative.
NOW, THEREFO BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA:

Section 1. Ordinance No. 82 -13, adopted by the

City Council on the 13th day of May, 1982, which appointed
i t
five members to the Community Redevelopment Agency pursuant
lu to Florida Statute Section 163.356 is hereby repealed.
Section 2. Ordinance No. 85- 3' &,,' ; �a pted by:the :City;
}! Council on the 2nd day of July, 1985, which increased the
!I size of said Board to seven members is hereby repealed.'

Section 3. The City Commission of the City of
Boynton Beach, Florida is hereby appointed and declared to
be the Board of Commissioners and the governing body of the
Community Redevelopment Agency.
Section 4. The Mayor and the Vice -Mayor of the City
of Boynton Beach are hereby designated as Chairman and the
Vice- Chairman, respectively, of the Board of Commissioners
of the Community Redevelopment Agency.

i Section 5. That all ordinances or parts of ordinances

in conflict herewith be and the same are hereby repealed.
Section 61 Should any section or provision of this
bl ordinance or portion hereof, any paragraph, sentence, or
word be declared by a court of competent jurisdiction to be

I invalid, such decision shall not affect the remainder of
this ordinance.
Section 7. Authority is hereby granted to codify said
,I

ordinance.
Section 8. This ordinance shall become effective
immediately upon passage.
