O86-52ORDINANCE NO. ~-~-~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING ORDINANCE NO. 79-24 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAIN OF THE CITY BY ~iENDING THE LAND USE DESIGNATION OF A CERTAIN PARCEL WHICH IS MORE PARTICULARLY DESCRIBED HEREIN~ SAID LAND USE DESIGNATION IS BEING CHANGED FROM LOW DENSITY RESIDENTIAL TO INDUSTRIAL; AMENDING ANY }fA_PS ADOPTED IN ACCORDANCE WITH THE LAirD USE ELEMENT OF THE COMPREHENSIVE PLAN ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida., has adopted a Comprehensive Land Use Plan and as part of said Plan, a Land Use Element by Ordinance No. 79-24, in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Section 163.3184, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Council deems it in the best interests of the inhabitants of said City to amend the aforesaid Land Use Element of the Comprehensive Plan as adopted byi~the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITYCOUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Ordinance No. 79-24 of the City is hereby amended to reflect that the Land Use of the following des- cribed land is hereby changed from Low Density Residential to Industrial. Said parcel of land is more particularly described as follows: See attached Exhibit "A" Section 2: That any maps adopted in accordance with the Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3: Ail ordinances or parts of ordinances in .onflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competen jurisdiction to be invalid, such decision shall, not affect the remainder of thi,s Ordinance. SectiQn 5: This Ordinance shall~become effective immediately upon passage. SECOND READING and FINAL PASSAGE this /~day of 1986. ATTEST: CITY OF BOYNTON BEACH, FLORIDA (SEAL) EXHIBIT "A" DESCRIPTION OF PARCEL HIGH RIDGE CENTER A parcel of land in Government Lot 1, Section 17, Township 45 South, Range 43 East, County of Palm Beach, State of Florida, more particularly described as follows: Beginning at the Northeast corner of Section 17, Township 45 South, Range 43 East; (beginning point also being the northeast corner of Government Lot 1); thence running South 01o21'38'' East, along the East line of said Section 17 and Government Lot 1, a distance of 1311.10 feet to a point on the north corporation line of Boynton Beach (as referred to in Official Record Book 1804, page 225), thence running South 88°38'41'' West, along said North corporation line a distance of 413.43 feet to a point; thence running North 00012'57'' West, a distance of 1310.76 feet to a point on the North line of said Section 17 and Government Lot 1; thence running North 88°33'21'' East, along said North line, a distance of 387.04 feet to the Point of Beginning.
