O86-51ORDINANCE NO.. f~'~"/ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ~NDING ORDINANCE NO. 79-24 OF SAID CITY BY AMENDING THE lAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY~BY ~4ENDING THE LAND USE DESIGNATION OF A CERTAIN PARCEL OF LAND WHICH IS MORE PARTICULARLY DESCRIBED HEREIN; SAID .LAND USE DESIGNATION IS BEING CHANGED FROM HIGH DENSITY P~SIDENTIAL TO LOCAL RETAIL COPR,~RCIAL; Ab~NDINGANY MAPS ADOPTED IN-ACCOP~ANCE WITH THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILTY CLAUSE, AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida, as adopted a Comprehensive Land Use Plan and as part of said Plan, a Land Use Element by Ordinance No. 79-24, in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the procedure for amendment of a Land Use EleMent of a Comprehensive Plan as set forth in Section 163.3184, Florida Statutes, has been followed: and WHEREAS, after public hearing and study, the City Council deems it in the best~interests of the inhabitants of said City to amend the aforesaid Land Use Element of the Comprehensive Plan as adopted by the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Ordinance No. 79-24 of the City is hereby amended to reflect that the Land Use of the following des- cribed land is hereby changed from High Density Residential to Local Retail Commercial. Said parcel of land is more particularly described as follows: See attached Exhibit "A" Section 2: That any maps adopted in accordance witt Element of said Comprehensive Plan shall be amended Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
