AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 16, "PARKS AND RECREATION", ARTICLE
II, "CITY PARKS AND BEACHES" BY AMENDING
SECTION 16-39, "ANIMALS PROHIBITED," TO
PROVIDE FOR ALLOWING LAW ENFORCEMENT
ANIMALS AND SERVICE ANIMALS ON BEACH AND
PARKS WITHIN THE CITY; PROVIDING FOR
CONFLICT, SEVERABILITY, CODIFICATION AND AN
EFFECTIVE DATE.

WHEREAS, staff has become aware that the City of Boynton Beach Code of
Ordinances prohibits all animals from the City's beaches and parks, including those animals
that should be reasonably allowed on the beach and in the parks; and
WHEREAS, the City Commission of the City of Boynton Beach, Florida has
determined that it is in the best interests of the citizens and residents of the City to amend the
Code to provide for the allowance of animals used by law enforcement and service animals on
the beaches and parks within in the City.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:

Section 1.
The foregoing "Whereas" clauses are true and correct and incorporated
24 herein by this reference.
25 Section 2. That Chapter 16, " Parks and Recreation", Article II "City Parks and
26 Beaches" Section 16-39, "Animals Prohibited," is hereby amended by adding the words and
27 figures in underlined type, and by deleting the words and figures in struck-through type, as
28 follows:

No person shall have, or be permitted to have, any dog or other
domestic animals on any designated beach or park area at any time whether
muzzled, leashed or not; provided that dogs, cats and other domestic animals
are permitted to remain in a parked vehicle in properly designated parking
areas but no domestic animal shall be permitted to run at large. Animals used

\ by law enforcement or service animals, trained to aid persons with disabilities,
2 shall be exempt from this section.

4 Section 3. Should any section or provision of this ordinance or portion hereof, any
5 paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid,
6 such decision shall not affect the remainder of this ordinance.

Section 4.
Authority is hereby granted to codify said ordinance.
8 Section 5. This ordinance shall become effective immediately upon passage.
