AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE
NO. 80-19 OF SAID CITY BY REZONING A CERTAIN
PARCEL OF LAND WITHIN THE CITY OF BOYNTON BEACH,
FLORIDA FROM P.U. (PUBLIC USAGE DISTRICT)
TO C-1 (OFFICE AND PROFESSIONAL COMMERCIAL
DISTRICT), SAID PARCEL BEING MORE PARTICULARLY
DESCRIBED HEREIN; AMENDING THE REVISED ZONING
MAP ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE,
A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida has heretofore adopted Ordinance No. 80-19 in which a
Revised Zoning Map was adopted for said 'City; and
WHEREAS, Bethes.da Memorial Hospital has heretofore
filed a Petition with the City of Boynton Beach, Florida pursuant-
to Section IX of Appendix A - Zoning of the Code of Ordinances,
City of Boynton Beach, Florida, for the purpose of rezoning a
certain parcel of land within the municipal limits of said City,
said property being more particularly described hereinafter, from
P.U.(Public Usage District) to C - 1 (Office and Professional
Commercial District); and
WHEREAS, the City Council deems it in the best interest
of the inhabitants of said City of amend the aforesaid Revised
Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA~ that:
Section 1: The following described land, loCated in
the City of Boynton Beach, Florida, to wit:
The Easterly 200 feet, as measured at right angles
to the West right of way line of Seacrest Boulevard',
of the ~ollowing described parcel of land in Section
33, Township 45 South, Range 43 East, Palm Beach
County, Florida, to-wit:
Beginning at the intersection of the Westerly right
of way line of Seacrest ~Boulevard with the North
line of Tract 14 of the subdivision of Section 33,
as recorded in Plat Book 1, page 4, Public Records
of Palm Beach County, Florida; thence Southwesterly
along said right of way line, a distance of 272.39
feet; thence Northwesterly, at right angles to the
preceding course, a distance of 419.69 feet;
thence Easterly, along a North line of Tract 14,
a distance of 500.29 feet to the Point of Beginning.
LESS AND NOT INCLUDING, the North 20 feet of the
parcel herein described.
AND TOGETHER WITH:
Lots 8 and 9, Pine Crest Ridge, Boynton Beach,
Palm Beach County, Florida, according the the plat
thereof recorded in Plat Book 24 at page 153 of the
Public Records of Palm Beach County, Florida.
Be and the same is hereby rezoned from P.U.(Public Usage District)
to C- 1 (Office and Professional Commercial District).
Section 2: The aforesaid Revised Zoning Map of the
City shall be amended accordingly.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of compete
jurisdication to be invalid, .such decision shall not affect the
remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon pas-sage.
