AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AUTHORIZING ABANDONMENT
OF AN EXISTING ALLEY LOCATED .EAST 0];'
FEDERAL HIGHWAY BETWEEN NORTH}=AST 7TH
AVENUE AND NORTHEAST 8TH AVENUE, SUBJICCT
TO STAFF COMMENTS; AUTHORIZING THE CITY
MANAGER TO EXECUTE A DISCLAIMER, WHICH
SHALL BE RECORDED WITH THIS ORDINANCE IN
THE PUBLIC RECORDS OF PALM BEACH COUNTYl
FLORIDA; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, staff is requesting that the City abandon an alley between Northeast ih
Avenue and Northeast 8th Avenue, along the boundary of the Lake Addition and Boynton Place
Subdivisions, subject to staff comments; and
WHEREAS, comments have been solicited from the appropriate City Departmenti;, and
public hearings have been held before the City's Community Redevelopment Age:lcy, and the
City Commission on the proposed abandonment; and
WHEREAS, staff finds that the alley no longer serves a public pmpose, and the City
Commission adopts that finding.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMlSSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The foregoing Whereas clauses are true and correct and lncorporated
herein by this reference.
Section 2. The City Commission of the City of Boynton Beach, Florida., does hereb
abandon an alley between Northeast ih Avenue and Northeast 8th Avenue, East of Federal
Highway, along the boundary of the Lake Addition and Boynton Place Subdivisions, subject to
staff comments. The property being abandoned is more particularly descltibed as follows:
That 7.5 foot strip of land as shown on the north side of Lot~: 1 and 3
through 22, in Block 1, according to the Plat of Boynton Place, as recordled
in Plat Book 11, Page 40, Public Records of Palm Beach County, Florida
And
That 6.3 foot strip ofland as shown on the sOW9 side of Lots 3 through 22,

franchised utility services operating within this strip of land.
NOTE: The property abandonment shall be divided according to the
common plat line that created each "half' of the property.
A location map is attached hereto as Exhibit "A."
Section 3. The City Manager is hereby authorized and directed to execute the
attached Disclaimer and cause the same to be filed, with this Ordinance, in the Public Records
of Palm Beach County, Florida.
Section 4.
This Ordinance shall take effect immediately upon passage.

Boynton Place Subdivisions, subject to staff comments. The property being abandoned is
more particularly described as follows:
