Minutes 09-14-07 MINUTES OF THE CITY OF BOYNTON BEACH AGENDA PREVIEW MEETING HELD IN BOYNTON BEACH, CITY COMMISSION CHAMBERS ON FRIDAY, SEPTEMBER 14, 2007 AT 9:00 A.M. Present: Jerry Taylor, Mayor Ron Weiland, Commissioner Carl McKoy, Commissioner Kurt Bressner, City Manager James Cheraf, City Attorney Janet Prainito, City Clerk Absent: Jose Rodriguez, Vice Mayor Mack McCray, Commissioner CALL TO ORDER: Mayor Taylor called the meeting to order at 9:00 a.m. 1.0.1. Additions, Deletions, Corrections Mayor Taylor noted an item would be added under VI. Consent Agenda, number five, approving the Interlocal Agreement with the Police Department and Briny Breezes. Commissioner Weiland suggested discussing under XII. New Business, re-instating the board recognition dinner with the monies coming fram the individual discretionary funds of the Commission. Mayor Taylor contended the item should be discussed in conjunction with the budget rather than as New Business. Commissioner Weiland agreed. Commissioner Weiland also requested staff look into the public utility right-of-way along Railroad Avenue. Apparently FP&L was unable to access a pole on a fenced property and delayed their access. He requested a report to avoid any further difficulties. Mr. Bressner requested information on the exact location and Commissioner Weiland replied the pole was located at Robinson's Towing, formerly Jordan's Towing. V.A. Appointments Mayor Taylor noted there was an applicant for the Education and Youth Advisory Board. VI. CONSENT AGENDA: Commissioner McKoy announced he would have two donations from his discretionary funds to be added. Mayor Taylor announced it would be the last meeting of the budget year for distribution of the discretionary funds. 1 Meeting Minutes Agenda Preview Conference Boynton Beach Florida VIII.A. Request for a one (1) year site plan time extension for Harbor Cay (NWSP 06-011) approved on May 2, 2006, from May 2, 2007 to May 2, 2008. (Tabled to September 18, 2007) Mr. Bressner anticipated questions by the adjacent development regarding the original conditions of approval as they relate to buffering. If the buffering was not sufficient the residents would request staff recommend additional measures. He noted the original site plan included a small piece of property to the east of the praposed development which is now not included. Mayor Taylor advised the Planning and Development Board had appraved the fence height, but had rejected the accessory building request. XII. B.3.Proposed Ordinance No. 07-026 Re: Amending Article 1 of Chapter 2, Section 2-13.2 relating to the Community Redevelopment Agency (CRA) to provide that the City Commission shall be the governing body of the CRA and the Mayor and Vice Mayor the CRA Chairperson and Vice- Chairperson. Commissioner McKoy questioned the need for an ordinance since the action had already been taken. Attorney Cherof advised the issue had not been addressed and dealt with the selection of the Chair and Vice Chair. Commissioner McKoy interpreted the ordinance to encompass two different actions relating to designating the chair and vice chair, plus the Commission being the governing body. Attorney Cherof clarified the pravisions of the Code of Ordinances had not been changed when the Commission designated itself as the CRA. The ordinance conforms the Code provision to the action of the Commission. Under statute, the Commission was permitted to designate itself as the CRA by resolution. The Code provision requires an ordinance to change the designation. XIV.
