OF THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING ORDINANCE NO. 79-24 OF
SAID CITY BY AMENDING THE LAND USE
ELEMENT OF THE COMPREHENSIVE PLAN
OF THE CITY BY ADOPTING THE PROPER
LAND USE OF CERTAIN PROPERTY WHICH
IS BEING ANNEXED INTO THE CITY BY
ORDINANCE SIMULTANEOUSLY HEREWITH,
WHICH IS MORE PARTICULARLY DESCRIBED
HEREINAFTER; SAID LAND DESIGNATION
IS BEING CHANGED FROM PALM BEACH
COUNTY COMMERCIAL POTENTIAL TO
CITY OF BOYNTON BEACH LOCAL RETAIL COMMERCIAL;
PROVIDING A SAVINGS CLAUSE;
REPEALING PROVISIONS; AND AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of
Boynton Beach, Florida has adopted a Comprehensive Land Use Plan
and as part of said Plan a Land Use Element by Ordinance No.
79-24, in accordance with the Local Government Comprehensive
Planning Act; and
WHEREAS, a certain parcel of
particularly described hereinafter is being

WHEREAS, the procedure for amendment of Land
Use Element of a comprehensive land use Comprehensive Plan as
set forth in Chapter 163, Florida Statutes, has been followed;
and
WHEREAS, after public hearing and study, the
City Council deems it in the best interests of the inhabitants
of said City to amend the aforesaid Land Use Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Ordinance No. 79-24 of the
City is hereby amended to reflect the following: That the Land

thereof as recorded in Plat Book
5, at page 73, of the Public
Records of Palm Beach County,
Florida, lying north of the
north right-of-way line of State
Road No. 804, less the north 54
feet of said Tract 8; being more
particularly described as
follows:
Commencing at a point of
intersection of the northerly
right-of-way line of New Boynton
Road (State Road No. 804) with
the easterly right-of-way line
of Knuth Road, as shown on State
Road Right-of-Way Map, Section
93640-2175, Sheet 2 of 3; thence
run N.00 31'22"W., along the
easterly right-of-way line of
said Knuth Road, for a distance
of 137.03 feet to a point:
thence run N.87 54'06"E. for a
distance of 313.98 feet to a
point of intersection with the
east line of said Tract
thence run S.O0 34'43"E. along
said east line of Tracl 9, for a
distance of 137.03 feet to a
point of intersection with the
northerly right-of-way line of
said New Boynton Road (State
Road No. 804); thence run S.87
54'06W., along the northerly
right-of-way line of New Boynton
Road (State Road No. 804), for a
distance of 314.11 feet to the
point of beginning. Said
described parcel of land lying
and being situated in Palm Beach
County, Florida.
Containing in all 0.99 acres,
more or less.
Subject to rights-of-way,
easements and other matters of
record.
The north 54 feet of Tract 8 of
the "Palm Beach Farms Company
No. 8", according to the plat
thereof as recorded in Plat Book
5, at page 73, of the Public
Records of Palm Beach County,
Florida, together with that 25
foot right-of-way lying north of
and contiguous to said Tract 8,
being bounded on the west by the
easterly right-of-way line of
Knuth Road, as shown on the
State Road Right-of-Way Map for
State Road No. 804, Section
93640-2175, Sheet 2 of 3, and
bounded on the east by the
northerly extension of the east
line of said Tract 8.
Containing in all 0.57 acres,
more or less.
Subject to rights-of-way,
easements and other matters of
record.
And including that portion of the
45 foot right-of-way known as Knuth
Road that abutts the west line of
said portion of land.
Section 2: That any maps adopted in
accordance with the Land Use Element of said Comprehensive Plan
shall be amended accordingly.
Section 3: Ail ordinances or parts
ordinances in conflict herewith are hereby repealed.

Section 4: Should any section or provision of
this Ordinance or any portion thereof be declared by a court of
competent jurisdictiion to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 5: This
effective immediately upon passage.
