AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, ANNEXING
A CERTAIN UNINCORPORATED TRACT OF LAND
THAT IS CONTIGUOUS TO THE CITY LIMITS
WITHIN PALM BEACH COUNTY, AND THAT WILL,
~UPON.ITS ANNEXATION, CONSTITUTE A REASONABLY
COMPACT ADDITION TO THE CITY TERRI~ORY~
SAID PROPERTY C~RISING THE EXISTING RIGHT-
OF-WAY FOR A PORT%ON OF GULF STREAM BOULEVARD,
PORTIONS OF FEDERAL HIGHWAY (U.S. 1),
PORTIONS OF HYPOLUXO ROAD, PORTIONS OF
OLD BOYNTON ROAD, AND ALL OF WINCHESTER
PARK BOULEVARD; PROVIDING A CONFLICTS
CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING
FOR ADVERTISING: PROVIDING AN EFFECTIVE DATE
AND AUTHORITY TO CODIFY; PROVIDING FOR
FILING WITH THE CLERK OF THE CIRCUIT COURT;
AND FOR OTHER PURPOSES.
WHEREAS, there exist certain rights-of-way presently
located i~unincorporated areas of Palm Beach County which are
contiguous t~ the City limits of the City of Boynton Beach, and
that will, upon their annexation, constitute a reasonable~
compact addition to the City territory.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA that:
Section 1: Pursuant to Section VII(32) of the Charter of
the City of Boynton Beach, Florida, and Section 171.044, Florida
Statutes, the following described unincorporated and contiguous
tracts of land situated and lying and being in the County of
Palm Beach, Florida, to-wit:
Property located within Section 4, Township
46 South, Range 43 East, more particularly
described as that part of the,right-of-way
for Gulf Stream Boulevard (S.E. 36 Avenue)
lying north of the South line of the North
half (N.1/2) of said Sectinn..4 and lying
between the west right-of-way line of Old
Dixie Highway and the southerly extension
of the East line of LOTS 3, 23,22, and 21,
all in BLOCK 8 GULF STRE~ ESTATES Plat
No. 2, as recorded in the Official Records
of Palm Beach County, Florida, in Plat Book
13, page 51; and
that part of the right-of-way of Federal
Highway (U.S. 1) lying between the North line
of the south half (S.1/2) of the Southwest
quarter (S.W. 1/4) of the Northeast quarter
(N.E. 1/4) of said Section 4, and a radial
line that is 291.2 feet south of the North
line of said Section 4, as measured along
the west right-of-way line of said Federal
Highway; and
that part of the right-of-way of said
Federal Highway lying between the easterly
extension of the south line of LOT 20
DELRAY BEACH ESTATES as recorded in Palm
Beach County public records in Plat Book
21 page 13, and the South line of the
Northeast quarter (N.E. 1/4) of said
Section 4; and
property located within Sections 5 and 6,
Township 45 South, Range 43 east, more
particularly described as three portions
of HypOluxo Road right-of-way lying north
of the South line of said Sections 5 and 6;
portion one lying between the west right-
of-way line of the Lake Worth Drainage
District E-4 Canal, and the west line of the
Southeast quarter (SQE. 1/4) of said Section
5; pOrtion two lying between the west line
of the Southeast quarter (S.E. 1/4) of the
Southeast quarter (S.E. 1/4) of said Section
6 and the northerly extension of the east
line of a parcel of land described as the
West one half (W. 1/2) of the East one half
(E. 1/2) of the Northwest quarter (NW 1/4)
of the Northeast quarter (NE 1/4) of Section
7, said Township 45 South;
and portion three lying between the northerly
extension of the west line of a parcel of land
described as the East.one half (E. 1/2) of the
West one half (W. 1/2) of s~id Northwest
quarter (NW. 1/4) of the Northeast quarter
(NE 1/4) of said Section 7 and the west line
of the Southeast quarter (SE 1/4) of said
Section 6; and
property located within Section 19, Township
45 South, Range 43 East, more particularly
deScribed as that part of the right-of-way
for Old Boynton Road lying between the southerly

Property located within Sections 19 and 30,
Township 45 South, Range 43 East, more
particularly described as all of the right-
of-way for Winchester Park Boulevard lying
between the south right-of-way line for Old
Boynton Road and the north right-of-way for
Boynton Beach Boulevard.
are hereby annexed to the City of Boynton Beach, Florida, and such
land so annexed shall be and become part of the City with the same
force and effect as though the same had been originally incorp-
orated in the territorial boundaries thereof.
Section 2: That Section VI and VI(a) of the Charter of
the City of Boynton Beach, Florida, is hereby amended to reflect
the annexation of said tracts of land more particularly described
in Section 1 of this Ordinance.
Section 3: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be de~&hred by a COurt of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 5: This Ordiannce shall not be passed until the
Same has been advertised for four (4) consecutive Weeks in a
newspaper of general circulation in the City of Boyton Beach,
Florida, as req~'ired by the City Charter and Section 171 044,
Florida Statutes.
Section 6: This Ordinance shall become effective
immediately Upon passage.
Section 8: This Ordinance, after adoption, shall be
filed with the Clerk of the Circuit
