AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 5 BUILDINGS, HOUSING AND CON-
STRUCTION REGULATIONS, ARTICLE I. IN
GENERAL, BY CREATING A NEW SECTION 5-6
ESTABLISHING A COASTAL BUILDING ZONE
FOR THE CITY AND PROVIDING THAT THE
COASTAL CONSTRUCTION CODE SHALL APPLY
TO ALL BUILDING WITHIN SAID COASTAL
BUILDING ZONE; PROVIDING AUTHORITY TO
CODIFY; PROVIDING A CONFLICTS CLAUSE;
A SEVERABILITY CLAUSE AND AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, that:
Section 1: Chapter 5 BUILDINGS, HOUSING AND CONSTRUCTION
REGULATIONS, ARTICLE I. In General, of the Code of Ordinances,
of the City of Boynton Beach, Florida is hereby amended by
creating a new Section 5-6 which shall read as fOllows:
Section 5-6. Coastal Building Zone
(a) There is hereby established as the Coastal
Building Zone for the City the land area from
the seasonal high-water line landward to a line
One Thousand Five Hundred Feet (1,500') land-
ward from the Coastal Construction Control
Line as established pursuant to Section 161.053,
Florida Statutes.
(b) The Coastal Construction Code which is
being adopted simultaneously herewith by a
separate Ordinance shall apply to all con-
struction within the Coastal Building Zone.
Section 2: Specific authority is hereby given to codify
this Ordinance.
Section 3: Ail ordinances or parts of ordinances in con-
flict herewith are hereby repealed.
Section 4: Should any provision of this Ordinance or any
portion thereof be declared by a court of competent jurisdiction
to be invalid, such decision shall not affect the remainder of
this Ordinance.
Section 5: This Ordinance shall become effective immedi-
ately upon passage.
