O86-07AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ANNEXING A CERTAIN UNINCORPORATED TRACT OF LAND THAT IS CONTIGUOUS TO THE CITY LII~ITS WITHIN PALM BEACH COUNTY, AND THAT WILL, UPON ITS ANNEXATION, CONSTITUTE A REASONABL~Z CO~IPACT ADDITION TO THE CITY TERRITORY; SAID PROPERTY COMPRISING THE EXISTING RIGHT-OF-WAY FOR A PORT%ON OF INTER- STATE HIGHWAY 1-95, A PORTION OF OLD DIXIE HIGHWAY, A PORTION OF FEDERAL HIGHWAY (US-i), A PORTION OF STATE ROAD A1A, A PORTION OF MINOR ROAD, A PORTION OF GROVE ROAD, A PORTION OF I~ENTONE ROAD, A PORTION OF SEACREST BOULEVARD, PORTIONS OF HYPOLUXO ROAD, A PORTION OF LAWRENCE ROAD AND A PORTION OF A N~LESS COUNTY'OWNED RIGHT-OF-WAY; PROVIDING A CONFLICTS CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING FOR ADVERTISING; PROVIDING AN EFFECT~IvE DATE AND AUTHORITY TO CODIFY; PROVIDING FOR FILING WITH THE CLERK OF THE CIRCUIT COURT; AND FOR OTHER PURPOSES. WHEREAS, there exist certain rights-of-way presently located in unincorporated areas of Palm Beach County which are contiguous to the City limits of the City of Boynton Beach, and that will, upon their annexation, constitute a reasonable compact addition to the City territory. NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA that: Section 1: Pursuant to Section VII(32) of the Charter of the City of Boynton Beach, Florida, and Section 171.044, Florida Statutes, the following described unincorporated and contiguous tracts of land situated and lying and being in the County of Palm Beach, Florida, to wit: Property located within Section 5, Township 46 South, Range 43 East, more particularly described as that part of the right-of-way for the Interstate Highway 1-95 lying between a line parallel to and 300 feet north of the east-west one quarter line of said Section 5 and the south line of said Section 5; and property located within Section 4, Township 46 South, Range 43 East more particularly described as that part of the 80 foot right- of-way for Old Dixie Highway lying between the one quarter line of said Section 4, and the westerly extension of the south line of LOT 20, DELRAY BEACH ESTATES as recorded in the Public Records of Palm Beach County, Florida in Plat Book 21 page 13; and that part of the right-of-way for Federal Highway (US-i) lying between the North line of said Section 4 and a line parallel to, and 291.2 feet south of said North line; and property located with Section 34, Township 45 South, Range 43 East, more~particularly described as that part the right-of-way for State Road A1A lying between the easterly extension of the north line of LOT 11BENSON BROTHERS subdivision as recorded in the Public Records of Palm ~each County, Florida in Plat Book 5, page 27, and a line parallel to, and 165.18 feet south of said North line; and property located within Section 16, Township 45 South, Range 43 East, more particularly described as the west 500.29 feet of a 50 foot right-of-way that is described in Said Public Records in Deed Book 947, pages 367 and 368, said property being adjacent to the south line of the Rolling Green Elementary School; and property located within SeCtion 9, Township 45 South, Range 43 East, more particularly described as the north one half of Minor Road right-of-way, lying between the northerly extension of the east line of parcel of land owned by the School Board of Palm Beach County, Florida, (Rolling Green Elementary) as recorded in the Public Records of said County, in Official Record Book 97, page 425 and the center line of Grove Road; and the east one half of Grove Road right-of-way, lying between the center line of said Minor Road and the easterly extension of the south line of BLOCK 12 SAN CASTLE 2nd. ADDITION as recorded in said Public Records in Plat Book 25, page 231; and the north one half of Mentone Road right-of-way, lying between the northerly extension of the west line of said BLOCK 12, and the aenter line of Seacrest Boulevard; and the west one half of Seacrest Boulevard right-of-way, lying between the westerly extension of the north right-of-way line of said Mentone Road and the east extension of the south line of TRACT 3, reserved of PALM BEACH MEMORIAL PARK~ as recorded in said Public Records in Plat Book 25, page 226; and property located within Sections 5 and 6, Township 45 South, Range 43 East, more particularly described as four portions of Hypoluxo Road right-of-way lying north of the South line of said Sections 5 and 6, portion one lying between the northerly extension of the west line of HIGH RIDGE SUBDIVISION, as recorded in said Public Records in Plat Book 22, page 6, and the west right-of-way line of the Lake Worth Drainage District E-4 Canal, portion two lying between the west line of the Southeast quarter (SE.l/4) of said Section 5 and the west line of the South- east quarter (SE.l/4) of the Southeast quarter (SE.l/4) of said section 6, portion three lying between the northerly extension of the east line of THE LAKES OF HYPOLUXO, as recorded in said Public Records in Plat Book **, page ***, and the northerly extension of the west line of said LAKES OF HYPOLUXO, and portion four lying between the west line of the Southeast quarter (SE.l/4) of said Section 6 and the west line of the South- east quarter (SE.l/4) of the Southwest quarter (SW.1/4) of said Section 6; and property located within Section 12, Township 45 South, Range 42 East, more particularly described as the west one half of Lawrence Road right-of-way lying between the westerly extension of the north line of the Southwest quarter (SW. 1/4) of the Northwest quarter (NW.1/4) of Section 7, Township 45 South, Range 43 East, and westerly extension of the south line of the said Northwest quarter (~.174) of Section 7. are hereby annexed to the City of Boynton Beach, Florida, and such land so annexed shall be and become part of the city with the same force and effect as though the same had been originally incorporated in the territorial boundaries thereof. Section 2: That Section VI and ~I(a) of the Charter of the City of Boynton Beach, Florida, is hereby amended to reflect the annexation of said tracts of land more particularly described in Section 1 of this Ordinance. Section 3: All.ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainde~ of this Ordinance. Section 5: This Ordinance shall not be passed until the same has been advertised for four (4) consecutive weeks in a newspaper of general circulation in the City of Boynton Beach, Florida, as required by the City Charter and Section 171.04 Florida Statutes. Section 6: immediately uponpassage. This Ordinance shall become effective Section 7: codify this Ordinance. Specific authority is hereby given to Section 8: This Ordinance, after adoption, shall be filed with the Clerk of the' Circuit Court of Palm Beach County, Florida.
