O85-43AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER 19. PLANNING AND DEVELOPMENT GENERALLY, ARTICLE III. COMe'UNITY APPEARANCE BOARD, SECTION 19-38. ESTABLISHED; MEMBERSHIP, QUALIFICATIONS. OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, FLORIDA, BY AMENDING SAID SECTION TO REDUCE THE NUMBER OF ALTERNATE MEMBERS ON THE CO~UNITY APPEARANCE BOARD FROM THREE (3) TO TWO (2); PROVIDING THAT EACH AND EVERY OTHER PROVISION OF CHAPTER 19. PLANNING AND DEVELOPMENT GENERALLY, ARTICLE III. COMe'UNITY APPEARANCE BOARD, SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING AUTHORITY TO CODIFY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: Chapter 19. PLAI~NING AND DEVELOPMENT GENERALLY, Article III. Community Appearance Board, Section 19-38. Established; membership, qualifications, of the Code of Ordinances City of Boynton Beach, Florida, is hereby amended to read as follows: Sec. 19-38. Established; membership, qualifications. A community appearance board is hereby established which shall consist of seven (7) regular members and ~h~ee-~ two (2) alternate members. At least one of the regular members of the board shall be a registered architect in the State of Florida, if available, and at least one of the regular members of the board shall be a registered or retired landscape architect or landscape designer. Each regular and alternate member of the board shall be a resident of the city. Section 2: Each and every other provision of Chapter 19. PLANNING AND DEVELOPMENT GENERALLY, Article III. Community Appearance Board, shall remain in full force and effect as previously enacted. Section 3: Specific authority is hereby given to codify this Ordinance. Section 4: Ail ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 5: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 6: This Ordinance shall become effective immediately upon passage.
