O85-37AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, TERMINATING
THE TEMPORARY MORATORIUM ON THE ISSUANCE
OF BUILDING PERMITS FOR THE CONSTRUCTION
OR ALTERATION OF BUILDINGS AND STRUCTURES
WITHIN THE DOWNTOWN BUSINESS DISTRICT OF
THE CITY OF BOYNTON BEACH, FLORIDA;
PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY
CLAUSE, AND AN EFPECTIVE DATE; AND FOR
OTHER PURPOSES.
WHEREAS, Ordinance No. 83-40 of the Code of Ordinances
of the City of Boynton Beach, Florida, declared a temporary
moratorium on the issuance of building permits for the constructior
or alteration of buildings and structures within the Downtown
Business District of the City; and
WHEREAS, Ordinance No. 83-40, as amended by Ordinance
Nos. 84-23 and 84-34, provided for the automatic repeal of
Ordinance No. 83-40 on the 360th calendar day after the date of
its adoption; and
WHEREAS, the Community Redevelopment Plan was adopted
by the City Council of the City of Boynton Beach, Florida, on
April 16, 1985.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: Ordinance No. 83-40, and all provisions
thereof, of the Code of Ordinances of the City of Boynton Beach,
Florida, is hereby repealed in its entirety.
Section 2: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 3: Should any section or provision of this
Ordinance or any portion thereof be declared'by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 4: This Ordinance shall take effect immediatel'
upon passage.
