O85-27ORD IN~NCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 85--20 OF SAID CITY BY REZONING SEVERAL PARCELS OF LAND WITHIN THE CITY OF BOYNTON BEACH, FLORIDA, FROM R-3 (MULTIPLE.FAMILY RESIDENTIAL), C-4 (GENERAL COMMERCIAL), C-3 (COMMUNITY COMMERCIAL), REC (RECREATION), AND PU (PUBLIC USAGE), ALL TO CBD (CENTRAL BUSINESS DISTRICT), SAID PARCELS BEING MORE PARTICULARLY DESCRIBED HEREIN; AMENDING THE REVISED ZONING MAP ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach~ Florida, has heretofore adopted Ordinance No. 85--2©~ in which a Revised Zoning Map was adopted for said City; and WHEREAS, Carmen S. Annunziato, Planning Director of the City of Boynton Beach, has heretofore filed a Petition with the City of Boynton Beach, Florida, pursuant to Section 9 of Beach, Appendix A-Zoning of the Code of Ordinances, City of Boynton Florida, for the purpose of rezoning certain parcels of land consisting of approximately 100.2 acres (+ or -), located within the municipal limits of said City, said property being more particularly described hereinafter, from R-3 (Multiple Family t Residential); C-4 (General Commercial); C-3 (Community Commercial); REC (Recreation); and PU (Public Usage), all to CBD (Central Business District); and WHEREAS, the Planning and Zoning Board of the City of Boynton Beach, Florida, has heretofore recommended approval of said rezoning request; and WHEREAS, the City Council deems it in the best interest~ of the inhabitants of the City to amend the aforesaid Revized Zoning Map as hereinafter set forth. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That the following described land, located in the City of Boynton Beach, Florida, to-wit: See attached Exhibit "A" be and the same is hereby rezoned from R-3 (Multiple Family Residential); C-4 (General Commercial); C-3 (Community Commercial)~_ ~C (Recreation); and P.U (Public Usage), all to CBD (Central Business District). Section 2: That the aforesaid Revized Zoning Map of the City shall be amended accordingly. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5: This Ordinance shall become effective immediately upon passage.
