O85-22ORDINANCE NO. ~--~--~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX A - ZONING, SECTION 10. BOARD OF ADJUSTMENT, SUBSECTION (A) (1) COMPOSITION AND PROCEDURE. TO PROVIDE THAT ALL MEMBERS OF THE BOARD OF ADJUSTMENT SHALL SERVE STAGGERED TERMS RANGING FROM ONE (1) TO THREE (3) YEARS, TO BE FOLLOWED BY TERMS OF THREE (3) YEARS THEREAFTER; PROVIDING THAT EACH AND EVERY OTHER PROVISION OF SUBSECTION (A) SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE, A SEVE~RABILITY CLAUSE, AUTHORITY TO CODIFY, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: Appendix A-Zoning, Section 10. Board of Adjustment, Subsection (A)(1). Composition and Procedure, of the Code of Ordinances of the City of Boynton Beach, Florida, is hereby amended to read as follows: A. COMPOSITION AND PROCEDURE: 1. The Board of Adjustment shall consist of seven (7) regular members and not more than two (2) alternate members, who shall be appointed by the City Council, ~-a~ia~mea~. Two (2) members shall serve for a term of one (1) year from the date of appointment; three (3) members shall serve for a term of two (2) years from the date of appointment; and two (2) members shall serve for a term of three (3) years from the date of appointment. Vacancies created after expiration of these terms shall be filled by appointments of three (3) year terms. One alternate shall serve for a term of one (1) year from the date of appointment; the other alternate shall serve for .a term of two (2) years from the date of appointment. Vacancies on the Board shall be filled by appointment by the City Council. Members of the Board may be removed by a majority of the total members of the City Council. Members and alternates of the Board shall be residents and electors of the City. Section 2: Each and every other provision of Section 10. Board of Adjustment, Subsection (A), shall remain in full force and effect as previously enacted. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of com- petent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance.
