O85-15AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA, ANNEXING
A CERTAIN UNINCORPORATED TRACT OF LAND THAT
IS CONTIGUOUS TO THE CITY LIMITS WITHIN
PALM BEACH COUNTY, AND THAT WILL, UPON ITS
ANNEXATION, CONSTITUTE A REASONABLY COMPACT
ADDITION TO THE CITY TERRITORY; SAID PROPERTY
COMPRISING THE EXISTING RIGHT-OF-WAY FOR A
PORTION OF BOYNTON BEACH BOULEVARD, A PORTION
OF KNUTH ROAD, AND AN ALLEYWAY ABUTTING THE
BOYNTON BEACH PLAZA; PROVIDING A CONFLICTS
CLAUSE AND A SEVERABILITY CLAUSE; PROVIDING
FOR ADVERTISING; PROVIDING AN EFFECTIVE DATE
AND AUTHORITY TO CODIFY; PROVIDING FOR FILING
WITH THE CLERK OF THE CIRCUIT COURT; AND FOR
OTHER-PURPOSES.
WHEREAS, there exist certain rights-of-way presently
located in unincorporated areas of Palm Beach County which are
contiguous to the City limits of the City of Boynton Beach, and
that will, upon their annexation, constitute a reasonably compact
addition to the City territory; and
WHEREAS, the City Council has requested that the Board
of County Commissioners of Palm Beach County~ Florida, consent to
the annexation of these various rights-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Pursuant to Section VII(32) of the Charter
of the City of Boynton Beach, Florida, and Section 171.044,
Florida Statutes, the following described unincorporated and
contiguous tracts of land situated and lying and being in the
County of Palm Beach, Florida, to-wit:
Property located within Section 30,
Township 45 South, Range 43 East,
more particularly described as follows:
The 30 foot right-of-way abutting the
east line of LOTS C,D, and E, TRACT 3,
and LOTS A and B, TRACT 30, and said
30 foot right-of-way abutting the east
line of LOTS C,D, and E in said TRACT 30,
all in PALM BEACH FA~S COMPANY PLAT
NO. 8, as recorded in Plat Book 5, Page
73, of the Public Records of Palm Beach
County, Florida; and
The 106 foot right-of-way for State Road
804 (Boynton Beach Boulevard) abutting
the north line of the following existing
lots: LOT C, TRACT 3; LOT C, TRACT 4;
LOT C, TRACT 5; LOT C; TRACT 6; LOT C,
TRACT 7; and LOT C, TRACT 8, all in said
PALM BEACH FA~4S COMPANY PLAT NO. 8; and
The 30 foot right-of-way for Knuth Road
abutting the west line of TRACTS 8,25,40,
57,72,89,104, and 121, all in said PALM
BEACH FARMS COMPANY PLAT NO. 8;
are hereby annexed to the City of Boynton Beach, Florida, and
such land so annexed shall be and become part of the City with
the same force and effect as though the same had been originally
~.incorporated in the territorial boundaries thereof.
Section 2: That Section VI and VI(a) of the Charter of
the City of Boynton Beach, Florida, is hereby amended to reflect
~he annexation of said tracts of land more particularly described
in Section 1 of this Ordinance.
Section 3: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of competen
jurisdiction to be invalid, such decision shall not affect the
remainder of this Ordinance.
Section 5: This Ordinance shall not be passed until
the same has been advertised for four (4) consecutive weeks in
a newspaper of general circulation in the City of Boynton Beach,
Florida, as required by the City Charter and Section 171.044,
Florida Statutes.
Section 6: This Ordinance shall become effective
immediately upon passage.
Section 7: Specific authority is hereby given to
codify this Ordinance.
Section 8: This Ordinance, after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach County,
Florida.
