A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING THE CITY ATTORNEY OR HIS
DESIGNEE TO ACCEPT SERVICE OF PROCESS
ON BEHALF OF THE CITY OF BOYNTON BEACH;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, pursuant to Section 48.111, Florida Statutes, process
against any municipal corporation, agency, board, or commission,
department, or subdivision of the state of any county which has a governing
board, council, or commission of which is a body corporate shall be served
on the Mayor, Vice Mayor or on any member of the governing board, council
or commission; and
WHEREAS, the City Commission of the City of Boynton Beach deems
it to be in the best interests of the citizens and residents of the City to have
one central location within the City to accept service of process on behalf of
the City; and
WHEREAS, the City Commission does hereby authorize and direct the
City Attorney or his designee to accept service of process on behalf of the
City of Boynton Beach.
NOW, THEREFORE, BE IT RESOLVED 'BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH; FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton Beach,
Florida hereby authorizes and directs the City Attorney or his designee to
accept service of process on behalf of the City of Boynton Beach,
Section 2. This Resolution shall become effective immediately upon
passage.
