WHEREAS, City of Boynton Beach government has been utilizing SUNCOM long-distance telephone service in the conducting of city business, and has done so with considerable savings; and WHEREAS, the SUNCOM telephone communications service is provided by the State of Florida, Department of Management Services, Division of Communications; and WHEREAS, the City Commission of the City of Boynton Beach, Florida has deemed it to be in the best interests of the residents and citizens of the City of Boynton Beach to enter into a SUNCOM Network Services Agreement with the State of Florida, Department of Management Services, Division of Communications, thereby providing city government with cost-effective long distance telephone communications service. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, FlOrida does hereby authorize and direct the Mayor and City Clerk to execute a SUNCOM Network Services Agreement with the State of Florida, Department of Management Services, Division of Communications, providing city government with cost-effective long distance telephone communications service, a copy of said agreement being attached hereto as Exhibit "A", Section 2. Wnereas, the Using Agency has applied for services from the state telecommunications network known as SUNCOM; and Wnereas, the Using Agency complies with all requirements of Chanter 282, Florida Statutes, and the rules of DIVCOM; NOW THEREFORE, it is agreed: 1. DIVCOM shall provide SUNCOM Services to the Using Agency according to tne Services noted and detailed in Exhibit 1 to this AGREEMENT. 2. DIVCOM shall provide the Using Agency accessibility to SUNCOM. All lines not restricted by the Using Agency shall have access to SUNCOM. 3. Cnarges shall be paid to DIVCOM by the Using Agency for these services and shall be based upon the current rates established and published by the Division of Communications to all state aaencies and local government Communications Service Authorization (CSA) representatives. Tnese rates shall cover administrative costs as well as network utilization, and access costs. DIVCOM shall provide the Using Agency with an invoice each month for services utilized by the Using Agency, consistent with the billing system, rates and concepts used to develop tne overall SUNCOM rate structure and cost recovery methodology. 4. Nonpayment of an invoice presented to an agency within 40 consecutive calendar days constitutes sufficient reason for the Division of Communications to: (a) notify the applicable common carrier to terminate service to the agency in the case of a non -state agency; or (b) notify tne State of Florida Comptroller to transfer funds to the Department of Management Services unoer tne provision of Chapter 216.292(7), Florida Statutes, in the case of a state agency. If non payment is for a SUNCOM Network Service, in the case of a non -state agency, the SUNCOM Network Control Center (NCC) will be notified to block the non -state agency's access to the network. 5. The resale of any SUNCOM service to a non - qualified subscriber, where oualifiea subscribers are set forth in Chapter 282, F.S., is expressly prohibited. These SUNCOM number changes are in conjunction with the new digital SUNCOM Network. i In November you should receive a new 1986 -87 edition of the State of Florida Telephone Directory. This edition will reflect almost all SUNCOM number changes for the new network and will be labeled "Effective December 1, 1986" on the front cover. Do not use the 1985 directory or any previous edition after December 1st. SUNCOM users should cross reference present SUNCOM numbers with numbers for the new network. This will help avoid problems on December 1st, such as reaching a recording saying the number dialed is no longer a valid SUNCOM number, reaching a number that rings on your end only (no answer and no recording), or reaching a different location on the other side of the state when dialing an old SUNCOM NUMBER. Cross referencing may also help people avoid making two SUNCOM calls (a wrong number and a right number) when another SUNCOM location is dialed. Repeated dialing attempts on SUNCOM may cause serious network congestion and inhibit long- distance calling throughout the network. If a SUNCOM caller reaches your location by misdealing or by dialing an incorrect number, please tell the person that many SUNCOM numbers have changed and refer him or her to nhe NEW State of Florida Telephone Directory or to a StatF Operator for the correct SUNCOM number, NOTE: Our SUNCOM numbers will not change. Cheney, City Manager SUBJECT: SUNCOM Policy /Training In order to achieve substantial savings in long distance telephone costs the City contracted approximately two years ago with the State Division of Communications (DIVC114) to utilize the "SUNCOM" network. The SUNCOM network covers the continental U.S., Hawaii, Puerto Rico and the British Virgin Islands, as well as in -state calls outside our local (Delray Beach to West Palm Beach) area. It is the City's policy that all employees using City phones do the following: 1. Log all long distance calls and submit logs monthly to switchboard. 2. Use SUNCOM for all long distance calls (except when utilizing a modem for data transmissions). Failure to adhere to this policy results in unnecessary and unbudgeted commer- cial long distance billing and makes it difficult for the City to justify the need for additional SUNCOM trunk lines which will be required for the new phone system. Realizing that some employees have experienced difficulties or confusion in attempting to use the SUNCOM network, the City has arranged for DIVCOMM repre- sentatives to conduct training in the use of the system. Therefore, on Tuesday afternoon, June 24th, the following training is scheduled in the City Council Chambers: I. Agency Contact Training (1:30 - 2:30 P.M.) The STATE shall provide to the MUNICIPALITY access to the present state long distance communications system, or any future long distance system. All lines not restricted by the MUNICIPALITY shall have access to the state long distance communications system. 2. The MUNICIPALITY shall pay installation costs required to provide access to the state long distance communications system. The MUNICIPALITY shall also pay the installation costs for any additional access facilities to the state communications system. 3. The STATE shall provide invoices for long distance communications service. The amount of each invoice shall be the MUNICIPALITY'S pro rata share of the system usage and shall cover administrative costs as well as system utilization and shall be consistent with the charges to participating state agencies. The invoicing methods and policies that apply to state agencies shall be applicable to the MUNICIPALITY. If an invoice is not paid by its due date the STATE may terminate service after 30 days written notice. The MUNICIPALITY recognizes and agrees that invoicing concepts and system configurations are subject to change from time to time as a result of changes in applicable laws, rules, traffic patterns, and other conditions. 4. The STATE, as well as the MUNICIPALITY, will be required to provide a minimum of 30 days' written notice to the other party prior to termination of service, except as provided in Paragraph 5 hereof. 5. It is agreed that the obligations of each party hereunder are subject to the laws of Florida and subject to funds being lawfully available to fulfill such obligations.
