08-025 II I 1 ORDINANCE 08 - 0).$ 2 3 4 AN ORDINANCE OF THE CITY COMMISSIO OF THE 5 CITY OF BOYNTON BEACH, FLORIDA AM DING THE 6 COMMUNITY REDEVELOPMENT PLA TO EXPAND 7 THE BOUNDARY DESCRIPTION TO CLUDE REAL 8 PROPERTY HEREIN DESCRIBED ND COMMONL Y 9 REFERRED TO AS THE MUSEU F LIFESTYLE AND 10 FASHION HISTORY SITE; ACCEPTING A 11 RECOMMENDATION FRO THE COMMUNITY 12 REDEVELOPEMENT AGEN TO IMPLEMENT THE 13 AMENDMENTS PROVIDE HEREIN; DIRECTING THE 14 CITY ADMINISTRA TIO TO TAKE SUCH ACTION AS 15 NECESSARY TO EFF TUA TE THE INTENT OF THIS 16 ORDINANCE; P VIDING FOR CONFLICT, 17 SEVERABILITY, DIFICATION; PROVIDING FOR AN 18 EFFECTIVE DA T 19 20 WHEREAS, Florida 163.361 provides for amendment or modification of a 21 Community Redevelopme Plan including changes in boundaries of the redevelopment area to 22 dd land to or exclude I d from the redevelopment area; and 23 WHEREA , the City Commission has provided notice of and conducted a public hearing 24 n the propose modification of the Community Redevelopment Plan hereinafter set forth in 25 ;:6 HEREAS, the City Commission has heretofore described the boundaries of the 27 unity Redevelopment Area by adoption of Ordinance 00-59; and 28 WHEREAS, the City Commission finds that the properties which are the subject of this 29 oundary amendment constitute a reasonable and appropriate expansion of the Community edevelopment Area in that the properties encompass slum or blighted conditions; and WHEREAS, the City Commission has considered and accepts the recommendation from he Community Redevelopment Agency as expressed in Community Redevelopment Agency 33 esolution 2008-06; and 34 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE Page I of3 . \CA\Ordmances\CRA\CRA BOUNDARY AMENDMENT (museumjdoc I II , ~ 1 CITY OF BOYNTON BEACH, FLORIDA: 2 Section 1. That the foregoing "WHEREAS" clause is true and correct 3 ratified and confirmed by the City Commission. 4 Section 2. The Community Redevelopment Plan IS 5 boundaries of the Community Redevelopment Area to include 6 described. Section 2-13.5, which sets forth the legal descri IOn of the Community 7 Redevelopment Area, is amended to include the following prope ies: 8 Lot 7, Block 2 of BOWERS PARK, according to the at thereof as recorded in Plat 9 Book 11, Page 57, of the Public Records of Palm B ch County, Florida. 10 11 Lot 9, Block 2, of BOWERS PARK, accor mg to the Plat thereof, as recorded in 12 Plat Book 11, Page 57, of the Public Reco s of Palm Beach County, Florida. 13 14 Lots, 10, 11, 12, 13, 14, 15, 16 an 7, Block 2, of BOWERS PARK, according to 15 the Plat thereof as recorded in PI Book 11, Page 57, of the Public Records of Palm 16 Beach County, Florida. 17 18 19 Section 3. The City' administrative staff is directed to take appropriate action, 20 including but not limited to oordination of effort with the Community Redevelopment Agency 21 County Property Appraiser's office to effectuate the intent of this 22 ordinance. There sh I be no retroactive reallocation of ad valorem or TIF revenues between the 23 City and the Co munity Redevelopment Agency by virtue of the adoption of this Ordinance. 24 All prior ordinances or resolutions or parts thereof in conflict herewith are 25 hereby pealed to the extent of such conflict. I ! 26 If any section, sentence, clause, or phrase of this Ordinance is held to be 27 nvalid or unconstitutional by any court of competent jurisdiction, then said holding shall in no 28 I ay affect the validity of the remaining portions of this Ordinance.
