08-028 II I I ORDINANCE NO. 08- O~e 2 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH, 4 FLORIDA AMENDING LAND DEVELOPMENT 5 REGULATIONS, CHAPTER 21, ARTICLE IV, SECTION 5 6 "SIGNS ALLOWED IN INDUSTRIAL ZONING 7 DISTRICTS", BY AMENDING SUB-SECTION B TO 8 REDUCE THE MAXIMUM HEIGHT OF FREEST ANDING 9 SIGNS FROM TWENTY (20) TO TEN (10) FEET; 10 PROVIDING FOR CONFLICTS, SEVERABILITY, II CODIFICATION AND AN EFFECTIVE DATE. 12 13 14 WHEREAS, the Director of Planning and Zoning has recommended amendment to the 15 City's sign code to reduce the maximum height of signs in the M-l zoning district from twenty 16 (20) to ten (10) feet; and 17 WHEREAS, the City Commission has considered the recommendations and has 18 determined and finds that the reduction of maximum sign height is beneficial and will not 19 adversely impact business in the M-l zoning district. 20 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 21 THE CITY OF BOYNTON BEACH, FLORIDA, THAT: 22 Section 1. The foregoing whereas clause is true and correct and is now ratified and ,..,'"' confirmed by the City Commission. ~-' 24 Section 2. Chapter 21, article IV, Section 5B of the Land Development Regulations 25 of the City of Boynton Beach Code of Ordinances is hereby amended as follows: 26 Section 5. Signs allowed in industrial zoning districts. 27 The following signs are permitted and regulated in industrial zoning districts: 28 A. One (I) real estate sign advertising that a premises is for sale, rent or lease may be 29 placed on the premises and shall not exceed thirty-two (32) square feet in area, nor six (6) feet 30 in height. One (I) such sign is permitted for each street frontage. 31 B. One (1) freestanding sign, not exceeding sixty-four (64) square feet in area, advertising 32 activity occurring on the premises. Each and every other provision of the Land Development Regulations 2 not herein specifically amended, shall remain in full force and effect as originally adopted. 3 Section 4. All laws and ordinances applying to the City of Boynton Beach in 4 conflict with any provisions of this ordinance are hereby repealed. 5 Section 5. Should any section or provision of this Ordinance or any portion thereof 6 be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the 7 remainder of this Ordinance. 8 Section 6. Authority is hereby given to codify this Ordinance. 9 Section 7. This Ordinance shall become effective immediately. 10 FIRST READING this ,'l day of AUG~r ,2008.
