The foregoing whereas clause is true and correct and is now ratified and confirmed by the City Commission. Section 2. That Section 55 of the City Charter of the City of Boynton Beach ~hall be amended to read as follows: Sec. 50. COMPENSATION OF MAYOR AND Each member of the Cit Commission shall receive a sala not to exceed seVen hundred nine dollars 790.00 er member per month. __City Commission members shall not be ad'usted from the current amount of 2001. Se_ction 4. The title of the ballot and explanatory statement setting forth the substance of the proposed Charter Amendment shall appear on the ballot and shall read as follows: AN AMENDMENT TO CITY CHARTER SECTION 55 COMPENSATION OF MAYOR AND CITY COMMISSION THIS AMENDMENT WOULD INCREASE THE MONTHLY' COMPENSATION OF COMMISSION MEMBERS FROM $350.00 TO $790.00 AND INCREASE THE MAYOR'S MONTHLY COMPENSATION FROM $350.00 TO $1,000.00. THE INCREASE WILL TAKE EFFECT AFTER THE MUNICIPAL ELECTION OF 2001. SHOULD SECTION 55 OF THE CHARTER BE AMENDED PROPOSED? AS YES _ NO Section 5. The City Clerk of the City of Boynton Beach, Florida is hereby and directed to advertise the referendum election contemplated herein in rice with the Code of Ordinances of the City of Boynton Beach, the City Charter of City of Boynton Beach, and the State of Florida Election Code. Section 6. All Ordinances or parts of Ordinances, Resolutions or parts of ions in conflict herewith shall and the same are hereby repealed to the extent of conflict only upon passage of the referendum. If any clause, section or other part of this Ordinance shall be held by court of competent jurisdiction to be unconstitutional or invalid, such unconstitutiona, or invalid__part shall be considered as eliminated and not effecting the validity of the remaining POrtions of the Ordinance and its application shall remain in full force and effect.
