O00-40ORDINANCE NO. 0 00- Z/O AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA AMENDING LAND DEVELOPMENT REGULATIONS, CHAPTER 2, SECTION 11.H.e(12), PROVIDING FOR A CHANGE IN THE OFF-STREET PARKING REQUIREMENTS FOR CONDOMINIUM AND HOUSING DEVELOPMENT BUILDINGS AND OTHER FACILITIES; PROVIDING FOR SEVERABILITY, CODIFICATION EFFECTIVE DATE. RECREATION RECREATION CONFLICTS, AND AN WHEREAS, staff has recommended an amendment to the City's zoning ulations to allow for a change in the off-street parking requirements for condominium and housing development recreation buildings and other recreation facilities; and WHEREAS, upon recommendation of staff, the City Commission of the City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of the City of Boynton Beach to amend Chapter 2, Zoning, Section 11.H.e/(12), providing for a change in the off-street parking requirements for condominium and housing development recreation buildings and other recreation ; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. Chapter 2, Zoning, Section 11.H.3.(12), is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: H, PROVISION OF OFF-STREET PARKING SPACES. e. Recreation and amusement: (12) Condominium and housing development recreation buildings: ~ ,~, ,~, ~-,,~,,~, ~-,,~,,,~o.. A minimum of five parkinq s~aces, ~lus one (1) additional space per 300 square feet of qros~ floor area of office use for leasing or manaqement purpose~ located in recreation buildinqs or separate structures (AD.~ requlations shall qovern provisions of handicapped spaces) Section 2. Each and every other provision of Chapter 2 Zoning of the .and Development Regulations not herein specifically amended, shall remain in force and effect as originally adopted. Section 3. All laws and ordinances applying to the City of Boynton in conflict with any provisions of this ordinance are hereby repealed. Section 4. Should any section or provision of this Ordinance or any thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5. Section 6. FIRST READING this Authority is hereby given to codify this Ordinance. This Ordinance shall become effective immediately. day of July, 2000.
