O84-40AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 79-24 OF SAID CITY BY AMENDING THE LAND USE ELEMENT OF THE COMPREHENSIVE PLAN OF THE CITY BY AMENDING THE LAND USE DESIGNATION OF A CERTAIN PARCEL OF LAND WHICH IS MORE PARTICULARLY DESCRIBED HEREIN; SAID LAND USE DESIGNATION IS BEING CHANGED FROM HIGH-DENSITY RESIDENTIAL TO LOCAL RETAIL COmmERCIAL; AMENDING ANY MAPS ADOPTED IN ACCORDANCE WITH THE LAND USE ELiEMENT OF THE COMPREHENSIVE PLAN ACCORDINGLY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Boynton Beach, Florida, h~s adopted a Comprehensive Land Use Plan and as part of said Plan, a Land Use Element by Ordinance No. 79-24, in accordance with the Local Government Comprehensive Planning Act; and WHEREAS, the procedure for amendment of a Land Use Element of a Comprehensive Plan as set forth in Section 163.3184, Florida Statutes, has been followed; and WHEREAS, after public hearing and study, the City Council deems it in the bes% interests of the inhabitants of said City ~o amend the aforesaid Land Use Element of the Compre- hensive Plan as adopted by the City herein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Se~ction 1: That Ordinance No. 79-24 of the City is hereby amended to reflect that the land use of the following described lland is hereby changed from High-Density Residential to Local Retail Commercial. Said parcel of land is more particularliy described as follows: PARCEL 1: Lots 130,131,132,133, Block C, BOYNTON HILLS, according to the plat thereof on file in the Office of the Clerk of the Circuit Court in and for Palm Beach County, Florida, recorded in Plat Book 4, page 51. PARCEL 2: Commence at the Southwest corner of Lot 130, Block C, BOYNTON HILLS, Plat Book 4, Paoe 51, Public Records of Palm Beach County, Florida; thence proceed Southerly a distance of 25' more or less to the center line of N.W. 7th Court (now vacated); thence proceed Southeasterly along the said center line of N.W. 7th Court, to the intersection of the now existing Westerly right-of-way line of Seacrest Boulevard (formerly Green Street); thence proceed Northerly along the Westerly right-of-way line of Seacrest Boulevard to the Southeast corner of said Lot 130, Block C, BOYNTON HILLS; thence proceed Northwesterly along the Southerly line of said Lot 130, Block C, BOYNTON HILLS, to the POINT OF BEGINNING. Section 2: That any maps adopted in accordance with the Land Use Element of said Comprehensive Plan shall be amended accordingly. Section 3: Ail ordinances or parts of ordinances in conflict herewith are hereby repe~led. Section 4: Should any section or provision of this Ordinance or any portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not effect the remainder of this Ordinance.
