CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 18. PENSIONS AND RETIREMENT,
ARTICLE IV. PENSIONS FOR FIREMEN, TO 'ADD
A NEW SECTION 18-180.1. TO DEFINE THE
EARLY RETIREMENT BENEFIT CALCULATIONS FOR
THE FIREMEN'S RELIEF AND PENSION TRUST
FUND; PROVIDING THAT EACH AND EVERY OTHER
PROVISION OF CHAPTER 18, ARTICLE IV, SHALL
REMAIN'IN FULL FORCE kND EFFECT AS
PREVIOUSLY ENACTED; PROVIDING A CONFLICTS
CLAUSE, A SEVERABILITY CLAUSE, AND AN
EFFECTIVE DATE; PROVIDING AUTHORITY TO
CODIFY; AND FOR OTHER PURPOSES.
WHEREAS, it is deemed advisable by the City Council
of the City of Boynton Beach, Florida, to officially declare
the definition of early retirement benefits for the Firemen's
Relief and Pension Trust Fund.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: That Chapter 18. Pensions and Retirement.
Article IV. Pensions for Firemen. be hereby amended to create a
new Section 18-180.1, as follows:
Section 18-180.1. Computation of Monthly
Retirement Income in the Instance of EarIy
Retirement.
The benefit payable for early retirement
shall be the same as determined for normal
retirement, as set forth in Section 18-180,
less five per cent (5%) for each year or
portion thereof for which the member's
actual retirement date precedes the date
which would have been the member's normal
retirement date had he remained in full time
employment with the City.
Section 2: Each and every other provision of
Chapter 18, Article IV, will remain in full force and effect
as previously enacted.
Section 3: All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 4: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective
immediately upon passage.
Section 6: Specific authority is hereby given to
codify this Ordinance.
