O84-34AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AMENDING ORDINANCE NO.
83-40 BY EXTENDING A TEMPORARY MORATORIUM
ON THE ISSUANCE OF BUILDING PERMITS FOR
THE CONSTRUCTION OR ALTERATION OF
BUILDINGS AND STRUCTURES WITHIN THE
DOWNTOWN BUSINESS DISTRICT OF THE CITY;
PROVIDING FOR AUTOMATIC REPEAL; PROVIDING
AN EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, Ordinance No. 83-40 declared a temporary
moratorium on the issuance of building permits for the
construction or alteration of buildings and structures
within the downtown business district of the City; and
WHEREAS, Ordinance 83-40 indicated in Section 7
that there would be an automatic repeal of the provisions of
the ordinance as of 11:50 P.M. on the 180th calendar day
after the date of adoption; and
WHEREAS, the date of adoption was December 6, 1983;
and
WHEREAS, Ordinance 84-23 extended this moratorium
for an additional 90 days amending Section 7 of Ordinance
83-40 to read "270th calendar day"; and
WHEREAS, the Community Redevelopment Plan has not
yet been adopted by the'Mayor and City Council of the City
of Boynton Beach°
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. All provisions of Ordinance No. 83-40
with the exception of Section 7 shall be reaffirmed and re-
adopted.
Section 2. Section 7 of Ordinance No. 83-40 is
hereby amended by deleting "270th calendar day" and substi-
tuting "360th calendar day".
Section 3. Effective Date. This Ordinance shall
take effect immediately upon~/~ad°pti°n'
