O84-31Il AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING APPENDIX A-ZONING OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, FLORIDA, TO AMEND SECTION 4. GENERAL PROVISIONS. F. HEIGHT LIMITATIONS AND EXCEPTIONS.TO AMEND SUBSECTION 4(a) TO PROVIDE THAT RECEIVING ANTENNA OF PRIVATE COMMUNITY ANTENNA SYSTEMS ~Y NOT EXCEED FORTY-FIVE (~5) FEET RATHER THAN SIXTY-FIVE (65) FEET UNLESS AN EXCEPTION IS GRANTED BY THE CITY CO~CIL; BY FURTHER AMENDING SECTION 4. GENERAL PROVISIONS. F, HEIGHT LIMITATIONS AND EXCEPTIONS. TO AMEND SUBSECTION 5 BY DELETING SUBSECTION 5(a) RELATING TO FREESTANDING BASE TOWERS IN RESIDENTIAL ZONES AND BY AMENDING SUBSECTION 5(b) TO PROVIDE THAT NO FREESTANDING BASE TOWER AND ANTENNA SHALL EXCEED FORTY-FIVE (45) FEET~ RATHER THAN SIXTY (60) FEET; BY RENUMBERING SECTION 4. GENERAL PROVISIONS. F. HEIGHT LIMITATIONS AND EXCEPTIONS. SUBSECTION 5 TO COMPLY WITH THE ABOVE REFERENCED AMENDMENTS; TO PROVIDE THAT EACH AND EVERY OTHER PROVISION OF SECTION 4. GENEPLAL PROVISIONS. OF APPENDIX A-ZONING SHALL REMAIN IN FULL FORCE AND EFFECT AS PREVIOUSLY ENACTED; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE; PROVIDING AUTHORITY TO CODIFY; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CiTY OF BOYNTON BEACH, FLORIDA, THAT: Section i: Appendix A-Zoning of the Code of Ordinances, City of Boynton Beach, Florida, Section 4. General Provisions. F. HEIGHT LIMITATIONS AND EXCEPTIONS, Subsections (4) and (5), are hereby amended to read as follows: In residential zones, freestanding television and citizens' band broadcasting antennae may not exceed twenty-five (25) feet in height, and no freestanding antenna may be constructed within the building setback lines. Roof- mounted or wall-supported antennae may exceed the maximum district height regulation by ten (10) feet; but in no instance, may an antenna exceed the roof-line height by more than fifteen (15) feet. With respect to private community antenna systems as defined in this Code, the aforesaid twenty-five (25) feet height regulation shall not apply. In the instance of private community antenna systems, the receiving antenna may not exceed s~%~-~ve- ~6~ fo_~_~-five (45) feet in height unless an exception is granted.by the City Council, and no part of any receiving antenna may encroach in any setback. g In residential zones, freestanding transmitting antennae are subject to the following limitations: No freestanding base tower and antenna shall exceed s&m%M-~6e~ forty-five (45) feet in height. eT b. No freestanding base tower with or without an antenna shall be constructed within the building setback lines. ~ c. No freestanding base tower shall be constructed without having first secured a permit from the City Building Official. Roof mounted transmitting antennae shall not exceed the roof-line height by more than twenty (20) feet. Section 2: Each and every other provision of Appendix A-Zoning of the Code of Ordinances, City of Boynton Beach, Florida Section 4. General Provisions. shall remain in full force and effect as previously enacted. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or a portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5: This Ordinance shall become effective ten (10) days after passage.
