O84-20AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH~ FLORIDA, AMENDING CHAPTER 16. PARKS AND RECREATION. ARTICLE III. BOATS AND BOATING~ OF THE CODE OF ORDINANCES, CITY OF BOYNTON BEACH, FLORIDA, TO CREATE A NEW SECTION 16-94.5 PROHIBITING THE MOORING OR FASTENING OF A VESSEL IN THE INTRACOASTAL WATERWAY TO THE WOODEN OVERLOOK BUILT AT THE TErmINUS OF CASA LO~.~ BOULEVARD IN THE CITY OF BOYNTON BEACH, FLORIDA; PROVIDING AUTHORITY TO CODIFY; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE,AND AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. WHEREAS, the City of Boynton Beach, Florida, has caused to be constructed a wooden overlook along the Intracoastal Waterway at the terminus of Casa Loma Boulevard in the City of Boynton Beach, Florida; and WHEREAS, said overlook has been designed and constructed for the purpose of permitting citizens and visitors to the City of Boynton Beach, Florida, to fish from and generally enjoy the view of the Intracoastal Waterway from the same; and WHEREAS, said overlook has not been designed nor constructed for the purpose of mooring or docking vessels thereto; and I~EREAS, it is in the general health, safety and welfare of the citizens and inhabitants of the City of Boynton Beach,Florida, that vessels in the Intracoastal Waterway be prohibited from mooring or docking to said overlook. NOW, THEREFORE, BE IT' ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1: Chapter 16. Parks and recreation. Article III. Boats and boating, of the Code of Ordinances, City of Boynton Beach, Florida, is hereby amended by adding a new Section 16-94.5 as follows: Section 16-94.5 ~ooring or docking prohibited No persons shall moor or fasten a vessel in thelIntracoastal Waterway to the wooden overlook built along the Intracoastal Waterway at the terminus of Casa Loma Boulevard, except in case of emergency. Section 2: Specific authority is hereby given to codify this Ordinance. Section 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4: Should any section or provision of this Ordinance or a portion thereof be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 5: This Ordinance shall become effective ten days after passage. FIRST READING this day of ~l w 1984.
