AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA~ AMENDING
CHAPTER 3 - ALCOHOLIC BEVERAGES, SECTION
3-4 OF THE CODE OF ORDINANCES OF THE
CITY OF BOYNTON BEACH, FLORIDA, RELATIVE
TO THE HOURS OF SALE OF ALCOHOLIC BEVERAGES
ON NEW YEARS EVE; PROVIDING AUTHORITY TO
CODIFY, A CONFLICTS CLAUSE, A SEVERABILITY
CLAUSE, AND AN EFFECTIVE DATE; A~JD FOR
OTHER PURPOSES.
WHEREAS, Ordinance No. 82-2 concerning bar closings
was adopted by the City Council on the 19th daY of January, 1982;
WHEREAS, a referendum concerning the matter of bar
and
closing hours had been previously adopted; and
WHEREAS, Ordinance No. 82-2 is more restrictive than
the referendum that was adopted by the voters of the City.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Chapter 3 - Alcoholic Beverages, Section
3-4. Hours of Sale. (c) of the Code of Ordinances of the City of
Boynton Beach, Florida, is hereby amended to read as follows:

The above time limitations prohibiting
sale, delivery or consumption of
alcoholic beverages of more than one
per cent (1%) alcohol by weight,
between the hours of 2:00 a.m. and
8:00 a.m. on all days except Sunday
shall not be applicable on January

Section 2: Each and every other provision contained in
Chapter 3. Alcoholic Beverages, Section 3-4. Hours of Sale. shall
remain in full force and effect as previously enacted.
Section 3:

Section 4:
Specific authority is hereby given to codify
Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5: Should any section or provision of this
Ordinance or a portion thereof be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the
remainder of this Ordinance.
Section 6: This Ordinance shall become effective ten
(!0) days after passage.
