AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF BOYNTON BEACH, FLORIDA, AMENDING CHAPTER
5 BUILDING, HOUSING, AND CONSTRUCTION
REGULATIONS, ARTICLE I. IN GENERAL, OF THE
"CODE OF ORDINANCES, CITY OF BOYNTON BEACH,
FLORIDA," TO AMEND SECTION 5-5,
ACCESSIBILITY BY HANDICAPPED, PROVIDING
AUTHORITY TO CODIFY; PROVIDING A CONFLICTS
CLAUSE, A SEVERABILITY CLAUSE, AND AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, finds it to be in the public' interest to have accessi-
bility to all dwelling units, hotel rooms, motels, single family
and duplex residences within the City by all residents and visi-
tors of the City, including the handicapped.
NOW, THEREFORE, BE AND IT IS HEREBY ORDAINED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That Chapter 5 - Buildings, Housing and
Construction Regulations, Article I. In General, of the Code of
Ordinances, City of Boynton Beach, Florida, is hereby amended to
read as follows:
Section 5-5. Accessibility by Handicapped
All interior doors in all dwelling units,
hotel rooms and motel rooms on first (lst)
floor only or ~1o--~ serviced by.elevators
shall have a minimum of twenty nine inches
(29") clear opening, (door of at least 32
inches in width) with the exception of
storage rooms and closets a~9~-~-~-h-
Section 2. Each and every other provision of Chapter
Building, Housing and Construction Regulations, Article I. In
General, shall remain in full force and effect as previously
enacted.
Section 3. Specific authority is hereby granted to
codify this Ordinance.
Section 4. All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5. Should any section or provision of this
Ordinance or a portion thereof be declared by a court of com-
petent jurisdiction to be invalid, such decision shall not affec
the remainder of this Ordinance.
Section 6. This Ordinance shall become effective ten
(10) days after passage.
