CITY OF BOYNTON BEACH, FLORIDA~ ~4ENDING
OP~INANCE NO. 83-41 TO MORE CLEARLY DEFINE
THE POWERS OF THE COMMUNITY REDEVELOPMENT
AGENCY IN DEVELOPING A COMMUNITY REDEVELOP-
MENT PLAN; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, on the 20th day of December, 1983, the City
Council of the City of Boynton Beach, Florida, duly enacted
Ordinance No. 83-41, establishing a redevelopment trust fund
pursuant to Section 163.387, Florida Statutes; and
WHEREAS, the City Council wishes to amend said
Ordinance to more clearly define the powers of the Community
Redevelopment Agency in developing a Community Redevelopment
Plan.
NOW, THEREFORE, BE IT OP~AINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: That Ordinance No. 83-41 shall be and
hereby is amended to add a new Section 8, which reads as follows:
Section 8: The Community Redevelopment
Agency shall exercise all powers and
expend all funds in accordance with the
provisions of Chapter 163, Part iii,
Florida Statutes, and any community
redevelopment plan shall conform with
the comprehensive plan of the City of
Boynton Beach, Florida, as amended.
Further, in development of the Community
Redevelopment Plan, the Community Re-
development Agency shall comply in all
respects with the height limitations
imposed by the Zoning Code of the City,
and further such plan shall insure that
the quality of the wetlands and mangroves
will not be impaired except in conformity
with the comprehensive plan.
Section 2: This Ordinance shall become effective
immediately upon passage.
