CITY OF BOYNTON BEACHr FLORIDA, CORRECTING
A CLERICAL ERROR IN ORDINANCE NO. 83-45,
WHICH WAS ADOPTED ON DECEMBER 6, 1983, TO
DESIGNATE THE CORRECT BUILDING CODE SECTIONS
SO AS TO ADOPT THE STANDARD MECHANICAL
CODE AND STANDARD GAS CODE, 1982 EDITION,
TOGETHER WITH UNIFO~I MINIMUM PALM BEACH
COUNTY-WIDE AMENDMENTS AS RECO~iENDED BY
THE BUILDING CODE ADVISORY BOARD OF PALM
BEACH COUNTY, AS ~,[ENDED; PROVIDING A
CONFLICTS CLAUSE, A SEVERABILITY CLAUSE,
AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE
DATE; AND FOR OTHER PURPOSES.
~{EREAS, on December 6, 1983, the City Council of the
City of Boynton Beach, Florida, adopted Ordinance No. 83-45
relating to the adoption of the Standard Mechanical Code and
Gas Code, 1982 Edition; and
WHEREAS, a clerical error was contained in said
Ordinance in that the Section amended by said Ordinance was
designated as 5-70 of the City Code; and
WHEREAS, to properly adopt the Standard Mechanical
Code and Gas Code, amendments need to be made to Section 5-40
and Section 5-62 of the present Code of Ordinances; and
WHEP~AS, the City Council of the City of Boynton Beach,
Florida, desires to correct the clerical error in Ordinance
No. 83-45.
NOW, THEREFORE~ BE AND IT IS HEREBY ORDAINED BY THE
CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS:
Section 1: That Chapter 5. Buildings, Housing and
Construction Regulations, Article IV. Gas, Section 5-40. Code
adopted; fees. of the Code of Ordinances of the City of Boynton
Beach, Florida, is hereby amended as follows:
Section 5-40. Code adopted; fees.
The Standard Building Code, Part II,
~ 1982 Edition, See%~-~-~7 together
with uniform minimum Palm Beach county-wide
amendments thereto, as amended, copies of
which are now on file in the office of the
Building Official, is hereby adopted and
established as the Gas Code for the City.
Section 2: That Chapter 5. Buildings, Housing and
Construction Regulations, Article VI. Mechanical Regulations,
Section 5-62. COde adopted, of the Code of Ordinances, City of
Boynton Beach, Florida, is hereby amended as follows:
Section 5-62. Code adopted.
The Standard Mechanical Code, ~
1982 Edition, together with uniform
minimum Palm Beach county-wide amendments
thereto, copies of which are now on file
in the office of the Building Official of
the City, is adopted and established as
the Uniform Standard Mechanical Code of
the City.
Section 3: That the addendum listed as Appendix A
is attached hereto and made a part hereof by reference.
Section 4: Ail ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5: Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
effect the remainder of this Ordinance.
Section 6: Specific authority is hereby granted to
codify this Ordinance.
Section 7: This Ordinance shall become effective
immediately upon its passage.
