O84-02AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA, ~iENDING CHAPTER 2. ADMINISTRATION, ARTICLE II. CITY ~L~NAGER, SECTION 2-31. TEMPORARY ABSENCE OR DISABILITY. OF THE CODE OF ORDINANCES, CITY OF BOSTON BEACH, FLORIDA, BY REPEALING THE PRESENT ORDINANCE PRO- VISION AND SUBSTITUTING THEREFOR MORE CLEARLY DEFINED PROVISIONS RELATING TO THE TEMPORARY ABSENCE OR DISABILITY OF THE CITY ~LANAGER; PROVIDING A CONFLICTS CLAUSE, A SEVERABILITY CLAUSE, AND AUTHORITY TO CODIFY; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT OP~AINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1: That Chapter 2. Administration, Article II. City Manager, Section 2-31. Temporary absence or disability, of the Code of Ordinances, City of Boynton Beach, Florida, is hereby amended to read as follows: Section 2-31. Temporary absence or disability. BM-~e~er-f~½eR-w~h-~he-e~M-e~e~w-~he (a) When the City Manager shall be out of the City for more than forty-eight (48) hours (not including Saturday, Sunday. and holidays), he shall inform the City Council of his proposed absence and will indicate to the City Council who will be administratively in charge of the City for routine matters. This action shall not constitute the appointment of an acting City Manager. (b) When, due to length of absence from the City or illness, and inability to be in reasonable contact by telephone, the City Manager is unable to carry out administrative duties and responsibilities in a reasonable time, the City Manager, with C~ty Council approval, shall designate an acting ~ity Manager to temporarily carry out the necessary duties of the City Manager. Section 2: That all ordina~ in conflict herewith are hereby repeal, Section 3: That should any this Ordinance or any portion thereof ~ces or parts of ordinances ~,d. section or provision of ~e declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this Ordinance. Section 4: Specific authority is hereby granted to codify this Ordinance. Section 5: This Ordinance shall become effective immediately upon passage.
