CALL TO ORDER
City Manager Bressner began the agenda review at 4:05 p.m.
V[.C.1 Proposed Resolution No. R01.- Re: Approving Commercial
Material Purchase Agreement between the Solid Waste Authority and the City of
Boynton Beach for recycled material
Commissioner Ferguson inquired regarding the cost for hauling the recycled materials and City
Manager Bressner said he will get that information to the Commissioners at the Commission
meeting on August 7TM,
· :. VZ.D.2 Ratification of Planning & Development Board Action: Quantum Lots 73-A
- 76 - Request to construct a one-story, 1.96,486 square foot office/warehouse
building on a 1.3.75-acre parcel. Of the total building area, 39,297 square feet or
:1.9.9% will be allocated for office use
Commissioner Ferguson will pull this item for discussion at the City Commission meeting.
o:. VZ.D.3 Ratification of Planning & Development Board Action: Hotel Apartment
Definition/Candlewood Tower Plaza, Northeast corner of Congress Avenue & SW
30th Avenue - Request to amend the Land Development Regulations, Chapter I.,
Article 2 "Definitions" by amending the definition for a "Hotel Apartment" to
eliminate the maximum percentage of apartment suites allowed ('APPZICAT'~rON

This request has been withdrawn. However, City Manager Bressner is providing a report for
Bob Ensler concerning comparative codes from other communities regarding the distance
requirements of hotels from churches and schools. He will provide the Commission with this
report also.

V~.P. Approve the additional payment of engineering and inspection fees in the
amount of $27,989 to Post Buckley Schuh & 3ernigan for the Gateway Boulevard
Roadway Improvement Project
City Manager Bressner explained that the City had requested these additional inspection
services with the understanding that the contractor would be paying for them. He said that
since the City is now in a dispute with the contractor, it is staff's recommendation that we pay
the consulting engineers for their inspections, as their support will be needed in any litigation
with the contractor.
VIII.A. Public hearing and adoption of the City of Boynton Beach's 2001/2002
Community Development Block Grant (CDBG) One-Year Action Plan (PROPOSED
RESOLUTION NO. R01- )
Commissioner Fisher requested copies of the score sheets and a breakdown of the $100,000
towards administrative costs. He also asked for discussion regarding the composition of the
review panel.
· :. ZX.B. Review of City Noise Regulations (August 2001)
City Manager Bressner stated that staff is revamping the methodology for enforcement using a
distance factor rather than a decibel rating, This item will be moved to the September 19th
Commission meeting.

1. 6.9 Capital Improvement Program, including potential funding such as
DIP and RAP (August 21, 2001)
This item can be removed because the Capital Improvement Program will be discussed at the
August 17th Commission meeting.

City Manager Bressner stated that an interlocal agreement is not necessary. Only an application
for funding will be required. He is attempting to get this item on the Palm Beach County
agenda for August 21~t.

· :. ZX.G. FRA Whistle Ban - Report (December 4, 2001)
City Manager Bressner stated that the administrator for the Federal Railway Administration has
not been appointed yet and it has been difficult for staff to deal with the Atlanta regional office
because no one can make decisions.
XZZ.B.1. Proposed Ordinance No. 01- Re: Amending Chapter
2 of the Land Development Regulations reducing the requirements appliceble to
non-conforming lots
City Manager Bressner explained that this ordinance would allow lots that are under the 60 feet
minimum frontage and 6,000 square foot minimum area to be developed under certain
conditions.
He stated that in the future the Commission may have to deal with existing non-conforming
buildings that developers wish to refurbish. City Manager Bressner will be requesting policy
guidance from the Community Redevelopment Agency, the Planning & Development Board and
the City Commission. Mayor Broening suggested that the City recruit experts in this area to
make a future presentation at a public meeting. City Manager Bressner will be working on a
redevelopment code for non-conforming lots and structures to be on the November agenda.

Mayor Broening stated that the Education Advisory Board wants to make a presentation at a
Commission meeting. It was the consensus of the Commission that the Board should submit a
proposed outline and then it would be placed on a future agenda.
Mayor Broening asked whether Advisory Board members terms would continue to begin in April
now that the City elections have been moved from March to November. City Manager Bressner
recommended leaving the Advisory Board terms as they are. The Commission requested that
there be language changes for Advisory Board attendance and conduct standards.
City Manager Bressner said that he would appreciate closure on the Community Reinvestment
funds by August 21%
It was mentioned that the letters regarding the fire assessment will be mailed out to property
owners on August 7t~. City Manager Bressner will provide a copy of the final letter to the
Commissioners.
Commissioner McCray inquired regarding the status of the evaluation/comment cards he had
requested be placed at all City facilities and he was told that the Recreation Department is
working on this. Customer service surveys on summer camps are almost completed per
Assistant City Manager Wilfred Hawkins.

Commissioner Fisher had a concern regarding canals being so full with all the rain we have had.
There was discussion regarding private drainage structures and whose responsibility it is to
notify Homeowners Associations to open their weirs. Assistant City Manager Dale Sugerman
will make telephone calls to the Lake Worth Drainage District and the Water Management
District asking them to contact the Homeowners Associations.
Commissioner McCray thanked everyone for their efforts in getting school buses to the new
high school this coming year.
There was discussion regarding drainage at the Banana Boat Restaurant's parking lot and at
various other locations within the vicinity.
Commissioner Fisher requested that the City Manager draft a letter to the School Board
regarding school boundary changes and requesting municipal involvement in the process.
Vice Mayor Weiland stated that Golfview Harbour residents are concerned regarding the noise
created by Tri-Rail and are even more concerned now that Tri-Rail will be building a second set
of tracks and reconstructing a bridge across the canal.
Mayor Broening suggested that this issue be taken to the Metropolitan Planning Organization.
City Manager Bressner said that staff will draft a letter to the MPO,
