2 A RESOLUTION OF THE CITY COMMISSION OF THE
3 CITY OF BOYNTON BEACH, FLORIDA,
4 DESIGNA TING ITS ELECTED POSITIONS FOR
5 INCLUSION IN THE ELECTED OFFICERS' CLASS OF
6 THE FLORIDA RETIREMENT SYSTEM; AND
7 PROVIDING AN EFFECTIVE DATE

9 WHEREAS, the Florida Legislature has provided the City of Boynton Beach elected
10 officials the ability to be included in the Elected Officers' Class of the Florida Retirement
11 System; and
12 WHEREAS, the City Commission adopted Ordinance No. 08-019 electing to
13 participate in the Florida Retirement System and desires such participation to be within the
14 Elected Officers' Class of the Florida Retirement System;
15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
16 THE CITY OF BOYNTON BEACH, FLORIDA THAT:
17 Section 1. The above referenced whereas clauses are incorporated herein by
18 reference.
19 Section 2. The City Commission of the City of Boynton Beach hereby designates
20 all its elective positions for inclusion in the Elected Officers' Class of the Florida Retirement
21 System.
22 Section 3. All resolutions or parts of resolutions in conflict herewith are hereby
23 repealed to the extent of such conflict.
24 Section 4. If any clause, section, other part or application of this resolution is held
25 by any Court of competent jurisdiction to be unconstitutional or invalid, in part or application,
26 it shall not affect the validity of the remaining portions or applications of this Resolution.

1 Section 5. This Resolution shall become effective immediately upon its passage
2 and adoption.
