12 WHEREAS, in October and November, 2008, a contract vendor was requested by
13 ode Compliance to mow the lots of the properties described in Exhibit "A"; and
14
15 WHEREAS, the owners of the parcel(s) of property hereinafter described were
16 nvoiced by the Finance Department on two occasions in an effort to recoup these costs with
17 o response; and
18
19 WHEREAS, said nuisance was not abated as required; and,
20
21 WHEREAS, on November 13 and December 31, 2008, all of the property owners
22 isted in the attached Exhibit "A" were sent letters offering them an opportunity to remit
23 ithin 30 days in order to avoid incurring a lien on their property; and
14
25 WHEREAS, the City Manager or his authorized representative has made a report of
26 osts actually incurred by the City and abatement of said nui'iance as to the property(s)
27 nvolved, which is described in Exhibit "A" attached to this Resolution; and
28
29 WHEREAS, upon passage of this Resolution, the property owners will be furnished
30 ith a copy of this Resolution, and given one more opportunity to remit all costs associated
31 ith the abatement in full within 30 days of the passage of the Resolution, before transmittal
32 o the County for recordation of Liens; and

35 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
36 HE CITY OF BOYNTON BEACH, FLORIDA AS FOLLOWS:

38 Section 1: Each Whereas clause set forth above is true and correct and
39 corporated herein by this reference.

41 Section 2: The amount of costs incurred by the City and the abatement of the
42 bove-described nuisance as to the parcels of land, owned and indicated to wit:

1 (Charges cover Invoices dated October 1 and November 25, 2008)
2 Subject amount is hereby assessed as liens against said parcels of land as
3 indicated, plus an additional administrative charge of $30.00 for each Lien.
4 Liens shall be of equal dignity with the taxes there from for the year 2008, and
5 shall be enforced and collected in like manner pursuant to applicable
6 provisions of law. In the event collection proceedings are necessary, the
7 property owner shall pay all costs of the proceedings, including reasonable
8 attorneys fees.

10 Section 3. This Resolution shall become effective immediately upon passage.
11
12 PASSED AND ADOPTED this 17th day of February, 2009.
