AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA
AMENDING CHAPTER 2. ZONING. SECTION
il(E) SWIMMING POOLS, TO EXCLUDE ABOVE
GROUND POOLS FROM THE MINIMUM REAR
SETBACK FOR STRUCTURES, AND ESTABLISHING
THE MINIMUM REAR SETBACK FOR ABOVE
GROUND POOLS AS 10 FEET; PROVIDING FOR
CODIFICATION, CONFLICTS, SEVER_ABILITY,
AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Boynton
Beach, Florida has determined that it is zn the best
interests of the citizens and residents of the City to
exclude above ground pools from the minimum rear setback for
structures and to establish the minimum rear setback for
above ground pools at 10 feet;
NOW THEREFORE, BE IT ORDAINED BY THE CITY CONiMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Chapter 2, Zoning, Section ll.E Swimming
Pools is hereby amended by adding the words and figures in
underlined type, and by deleting the words and figures in
struck-through type, as follows:
E. SWIMMING POOLS. Swimming pools shall be located,
designed, operated and maintained in accordance with the
city swimming pool ordinance and shall be subject to the
approval of the development department. No swimming pool
shall be constructed closer than eight (8) feet from any
property line eeet-- except that above qround swimminq pool~
shall meet a ten (10) foot rear setback. Ail ether setback
requirements for the applicable zoning district shall apply
to above qround pools. No swimming pools shall be built in
front of the building line. On corner lots, pools will
comply with the corner lot setback requirements of the

Section 2. Ail laws and ordinances applying to the
City of Boynton Beach in conflict with any provisions of
this ordinance are hereby repealed.
Section 3. Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
This Ordinance shall become effective
