O00-19ORDINANCE NO. 0 O0 - Iq AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING THE CITY OF BOYNTON BEACH MUNICIPAL FIREFIGHTERS PENSION TRUST FUND TO COMPLY WITH CHAPTER 175, FLORIDA STATUTES; AMENDING SECTION 18-185 OF THE CITY CODE TO PROVIDE FOR RETIREMENT AT AGE 55 WITH TEN YEARS OF SERVICE; AMENDING SECTION 18-180,1 OF THE CITY CODE TO PROVIDE FOR A REDUCED EARLY RETIREMENT PENALTY; AMENDING SECTION 18-182 OF THE CITY CODE TO PROVIDE THAT SERVICE INCURRED DISABILITY BENEFITS SHALL NOT BE OFFSET BELOW 420/0 OF AVERAGE FINAL COMPENSATION; AMENDING SECTION 18-183 OF THE CITY CODE TO PROVIDE FOR COMPUTATION OF AVERAGE FINAL SALARY BASED ON THE FIVE HIGHEST OF TEN YEARS; AMENDING SECTION 18-186 OF THE CITY CODE TO PROVIDE FOR TIMELY DEPOSIT OF MEMBER, STATE AND CITY CONTRIBUTIONS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE, WHEREAS, the Florida Legislature has revised the requirements for firefighter pension funds .receiving state monies under Chapter 175, Florida Statutes; and WHEREAS, the City of Boynton Beach Municipal Firefighters Pension Trust Fund receives Chapter 175 monies and is governed by the recent amendments to Chapter 175. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. That Chapter 18, Section 18-185 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 18.185. Normal Retirement Date. The normal retirement date of each firefighter will be the first of the month coinciding with, or next following, the e_arlier of the .....date on which such firefighter has attained and completed twenty (20) years of service ~ age or a_____~t ~)~~L~D_f ac~ with ~ars of se_rvice. There is no age requirement for a normal retirement. Section 2. That Chapter 18, Section 18-180.1 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 18.180.1. Computation of monthly retirement income in the instance of early retirement. The benefit payable for early retirement shall be the same as determined for .... e 3 er normal retirement, as set forth in section 18-180, less fi,,.-(-S~ thre (3_)_p cent for each year or portion thereof... Section 3. That Chapter 18, Section 18-182 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 18.182. Disability retirement benefits. (a) Service incurred. Any member who receives a medically substantiated service connected ... The reduction for social security shall terminate upon the attainment of age sixty-five (65). That Chapter 18, Section 18-183 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 18.183. Average final compensation defined; average annual compensation defined. (a) Average final compensation, for the purpose of calculating entitlement to benefits under this plan, shall mean the average cash compensation exclusive of bonuses and incentive pay received by a firefighter during the five (5) years of service with the city, with'm the asr ten ears which produces the highest average. Section 5. That Chapter 18, Section 18-186 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 18.186. Payroll deductions; ~State and City Contributions. The City of Boynton Beach shall deduct from all firefighters entitled to the benefits of the article, ... That Chapter 18, Section 18-179 is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: I :[8-179. Application. All other provisions of Chapter :[75, Florida Statutes, shall meet all the requirements and be fully applicable, except for the provisions of this article, to the City of Boynton Beach lVlunicipal Firefighters Pension Trust Fund. The increased pension benefits in the same percentage of increase as provided for by this article shall apply to all firefighters now receiving retirement benefits and all firefighters eligible for retirement benefits but not now retired, under the provisions of the City of Boynton Beach Municipal Firefighters Pension Trust Fund, Chapter :[75, Florida Statutes. A retiree receivin a 'oint and survivor for___m of benefit shall be ermitted to chane his or her beneficia as rovided in Section 175.:[71 and 175.333 Florida Statutes. Section 67.. Each and every other Section of Chapter :[8, not herein specifically amended, shall remain in full force and effect. Section ¥ 8. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section $9. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent iurisdiction to be invalid, such decision shall not affect the remainder of this 4 ordinance.
