R96-094RESOLUTION R96-~/-/¢ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO ENTER INTO AN AGREEMENT BETVVEEN THE CITY OF BOYNTON BEACH AND THE DEPARTMENT OF THE TREASURY, U.S. CUSTOMS SERVICE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, it is the intention of the Police Department to actively pursue illegal activity at or near Boat Ramp Park, and because of the City's close proximity to the Boynton Inlet; and WHEREAS, the Police Department has been in contact with The Department of the Treasury, U.S. Customs Service regarding assignment of an officer from the Directed Patrol Unit to the Customs Task Force on a part-time basis, which would be a valuable tool for intelligence and forfeiture possibilities; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida does hereby authorize and direct the Mayor and City Clerk to execute an Agreement between the City of Boynton Beach and The Department of the Treasury, U.S. Customs Service, said Agreement being attached hereto as Exhibit "A". Yannuzzi_.~4~ff REFERENCES: ENCLOSURES: Attached to this cover, please find documentation that requests the authorization of a member of the Directed Patrol Unit (D.P.U.) to join the U.S. Customs Task Force. As I mentioned to Chief Gage on May 8, 1996, this would involve, at the most, around eight (8) hours per week. Any overtime would be covered by U.S. Customs. I spoke with Der. Jim Burke of the Boca Raton Police Dept.(338-1333). He has been associated with the Task Force for eight (8) years, originally as a part of his assignment to Boca's Narcotics Unit. Currently, he has several ongoing investigations with them, but maintains that contact while assigned as a regular-assignment detective. Det. Burke did confirm that Boca Raton is reimbursed for any expenses he incurs. He submits a Police Department overtime request to both his U..S. Customs and his Boca Raton supervisors for their mutual signatures, Boca Raton pays him, and then he submits a monthly expense report to U.S. Customs for the City's reimbursement. Their joint ~perafions have been very successful. .... ~ then spoke with Lt. 'Gomez of the Jupiter Police Dept. (746-6201) who advised that their Marine Unit has an officer assigned to the Task Force. They also have been very successful with this relationship at a small cost in terms of lost time. Again, all overtime is reimbursed by U.S. Customs. Based on theabove information, I am recommending that we take advantage of this opportunity and process this request thru the City Attorney for eventual placement on the Agenda for the next available City Commission Meeting. Passalaqua REFERENCES: ENCLOSURES: I spoke with Jeff Martin the group supervisor of Customs, work 659-4606, beeper 551-0480, who is in charge of the Customs Task Force. My intentions are to actively work our boat ramp for drugs and or contraband. I contacted Jeff in regards to having somebody from my unit assigned to Customs for their intelligence on drug boats, that's when he approached me about the task force. He wants to have somebody assigned from Boynton Beach Police Department due to our close proximity to the inlet. He said the person assigned need not be with Customs for a 40 hour weelgoone day a week would be enough. He does want access to that officer when a big operation goes down. I gather the officer with a beeper would be subject to call and would be paid overtime for anything over 40 hours. The overtime would be paid by Customs as well as any expenses. He also said that any cases made in Boynton Beach by the task force would be Boynton cases, we would be able to go for forfeiture on any property ourselves. As far as the money confiscated Customs .... 7ould want a share of the money but not a share of the property. He said that Boca and Jupiter Police Department's have one officer each assigned and they spend about 8 hours a week with Customs and any call outs for operations. P.B.S.O. has an officer permanently assigned. I see this as a valuable tool for intelligence and forfeiture possibilities. Both Craig and myself are Customs Certified. But whoever we send up will be trained and Customs Certified. This is a valuable opportunity to expand our interdiction operation under the professional eyes of Customs. I have enclosed the guidelines and agreement from Customs. Jeff wants me to get back with him on Monday. He wants to meet with you and me to hash out the particulars and answer any questions we may have. Could you beep me Monday.
