WATE~ SEWERS AND CI'TY UTI'LI'TI'ES, ARTI'CLE V1'1'~, SECT?ON 26- 403(b), PROV~DI'NG FOR A RATE I'NCREASE FROM $1.00 PER EQUI'VALENT RES?DENT?AL UNI'T (EAU) TO $6.00 PER EAU FOR ALL I'MPROVED PROPERTI'ES WI'THI'N THE CTTY TO PROVZDE NECESSARY FUND~'NG FOR THE MANAGEMENT AND OPERAT?ON OF THE CTTY'S STORMWATER SYSTEM; PROVTDI'NG FOR CONFLI'CTS, SEVERABI'LI'TY, CODIFTCATi'ON AND AN EFFECTTVE DATE. WHEREAS, Chapter 26, Article VII of the City of Boynton Beach Code of Ordinances provides for the imposition of stormwater fees upon all improved properties within the City; and WHEREAS, Chapter 26, Article VII, Section 26-403 (b) of the Code of Ordinances provides that a monthly charge per ERU for improved properties within the City of Boynton Beach limits shall be one ($1.00) dollar; and WHEREAS, the City Commission of the City of Boynton, based upon the justification provided by the City's consulting engineer in a report dated March 15, 2000, and the outcome of the City Commission's workshop held on April 17, 2000, deems it to be in the best interests of the citizens and residents of the City to increase the stormwater utility fee from $1.00 per ERU per month to $6.00 per ERU month, to efficiently operate and maintain the stormwater management system. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: ! Section 1. Each Whereas clause set forth above is true and correct and incorporated herein by this reference. Section 2. That Chapter 26, Article VIII, Section 26-403(b) is hereby amended by adding the words and figures in underlined type, and by deleting the words and figures in struck-through type, as follows: 26-403. Schedule of rates. (a) The Director is directed... (b) The monthly charge per ERU for all improved properties within the City of Boynton Beach corporate limits shall be "'"'~ ""-'"'-"/¢~ ~m Six Dollars ($6.00). The City Commission may, from time to time, by ordinance amend the monthly charge established in this section. Section 3. Each and every other provision of Chapter 26, not herein specifically amended shall remain in full force and effect as previously enacted. Section 4. All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. Section 5. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to ordinance. Section 6.
