3 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
4 FLORIDA, AMENDING THE FINAL BUDGET FOR THE
5 FISCAL YEAR BEGINNING OCTOBER I, 2008, AND
6 ENDING SEPTEMBER 30, 2009 BY TRANSFERRING
7 BUDGETED FUNDS FROM THE FIRE ASSESSMENT
8 FUND TO THE GENERAL FUND IN THE AMOUNT OF
9 $3,174,665.00 AND INCREASING THE GENERAL FUND
10 APPROPRIATION IN THE AMOUNT OF $3,174,665.00
11 FOR THE PERSONNEL SERVICES AND OTHER
12 EXPENDITURES RELATED TO TWENTY-FOUR (24)
I3 FIREFIGHTERS; PROVIDING FOR SEVERABILITY,
14 CONFLICTS, AND AN EFFECTIVE DATE.

16 WHEREAS, a final budget was approved by the City Commission on September 18,
17 2008, for the 2008/09 fiscal year; and
18 WHEREAS, in recent years, personnel servIces and other expenditures related to
19 twenty-four (24) firefighters had been budgeted, expended and accounted for in the Fire
20 Assessment Fund; and
21 WHEREAS, the accounting for such expenditures is more appropriately expended from
22 and accounted for in the General Fund along with all other expenditures of the Fire
23 Department; and
24 WHEREAS, staff recommends approving this housekeeping item of the Financial
25 Services Department for the preferred method of accounting that was implemented in Fiscal
26 Year 2008-09.
27 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
28 THE CITY OF BOYNTON BEACH, FLORIDA:
29 Section I. The foregoing "Whereas" clauses are hereby ratified and confirmed as being
30 true and correct and are hereby made a specific part of this Resolution upon adoption hereof
31 Section 2. That the final budget of the City of Boynton Beach, Florida, for the
32 fiscal year beginning October 1,2008, and ending September 30, 2009, is hereby amended by
33 providing for a transfer of$3,174,665.00 budgeted in 2008/09 from the Fire Assessment Fund
34 to the General Fund and increase the General Fund appropriation by $3,174,665.00 for
35 personnel services and other expenditures related to twenty-four (24) firefighters which had

been budgeted, expended and accounted for in the Fire Assessment Fund.

Section 3.
All delinquent taxes collected during the ensuing fiscal year as proceeds
3 from levies of operation millages of prior years are hereby specifically appropriated for the use
4 of the General Fund.

Section 4.
If any clause, section or other part of this Resolution shall be held by
6 any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or
7 invalid part shall be considered as eliminated and shall in no way affect the validity of the
8 remaining portions of this Resolution.

Section 5.
If any clause, section or other part of this Resolution shall be held by
